## Checking plan

**Verify against sources**

In Victoria the Senior Practitioner authorises a restrictive practice by written order under section 27 of the Disability Act 2006. The authorisation categories are not interchangeable.

- What the AI does: From the behaviour support plan and the authorisation record, list each regulated restrictive practice, whether a Victorian authorisation covers it, and any gap. Do not decide that a use was lawful.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 27 applies to restrictive practices or compulsory treatment by a disability service provider or a registered NDIS provider. The Senior Practitioner may, by written order to that provider, authorise the use of a restrictive practice.
2. The Senior Practitioner's page gives that office the authorisation of chemical and environmental restraint, and the approval of seclusion, mechanical restraint and physical restraint, and of treatment plans for compulsory treatment.
3. For an NDIS participant, the same page says the Senior Practitioner approves authorised program officers, authorises regulated restrictive practices in an NDIS behaviour support plan, and gives additional approval of seclusion and of mechanical and physical restraint.
4. Section 27(5) requires the person, the NDIS participant or the relevant client to be advised in writing of an authorisation under section 27(2)(g) as soon as practicable. Section 27(5B) allows a prohibition on a restrictive practice, or a specified form of it, including by registered NDIS providers.

## Notes

- The state-funded path on the same page is different: an authorised program officer approved by the Secretary may approve inclusion of a practice in a plan and must lodge the plan. Do not use that path for an NDIS plan.
- The page also cites directions under sections 132ZY, 147A, 201I and 201O. Those sections were not opened. The Disability Act 2006 is in force as version 051, effective 24 May 2025. The section text was read on the current AustLII compilation.

## Practical guide

Jurisdiction: Victoria. Authorisation by the Victorian Senior Practitioner under the Disability Act 2006.

**Deliverable**: A list of each regulated practice and whether a Victorian authorisation covers it, with gaps marked.

**Inputs**

- The behaviour support plan
- The authorisation or approval record
- Whether the participant is on an NDIS plan

**Example**: Illustrative example: The plan lists seclusion. The file has an authorisation for chemical restraint only. The list marks seclusion as not covered. The lawyer decides what follows.

**Stop and escalate when**

- The authorisation record is missing.
- An NDIS plan has been checked on the state-funded lodging path.
