| How AI is used | Extract what the plan says the school may do, for how long, and whether it mentions a functional behavioural assessment or a review of the plan. Do not decide that the conduct is a manifestation of a disability. |
| What the lawyer must review | 20 U.S.C. § 1415, as opened, says that if the conduct is determined to be a manifestation of the child's disability, the IEP team reviews an existing behavioural intervention plan and modifies it as necessary, or, if there was no prior assessment, conducts a functional behavioural assessment and implements a behavioural intervention plan. Except for the special-circumstances removal, the child returns to the placement from which the child was removed unless the parent and the local educational agency agree to a change as part of modifying the plan. School personnel may remove a student to an interim alternative educational setting for not more than 45 school days, without regard to manifestation, where the child carries a weapon at school or a school function, knowingly possesses or uses illegal drugs or sells or solicits a controlled substance there, or inflicts serious bodily injury on another person there. The local educational agency notifies the parents of the disciplinary decision and of procedural safeguards not later than the date the decision is made. You apply these rules. They are not an NDIS restrictive-practice authorisation. |

## Notes

- This is a school discipline provision. It does not govern an adult disability-service provider.
- Definitions of weapon, illegal drug, controlled substance and serious bodily injury are cross-referred in the section and were not opened as separate texts.
