| How AI is used | List the date of each incident in the school file and the date of the behavioral intervention plan or functional behavioral assessment in the file. Write no manifestation decision. |
| What the lawyer must review | Section 1415 of Title 20 is a school discipline rule, not a rule for an adult disability-service provider and not an NDIS restrictive-practice authorisation. If the local educational agency, the parent, and relevant members of the IEP team determine that the conduct was a manifestation of the child's disability, the team must review and modify an existing behavioral intervention plan or, if there was none, conduct a functional behavioral assessment and implement a plan, and, except as subparagraph (G) provides, return the child to the placement unless the parent and the agency agree to a change as part of that modification. Subparagraph (G) allows removal to an interim alternative educational setting for not more than 45 school days without regard to manifestation where the child carries or possesses a weapon at school or a school function, knowingly possesses or uses illegal drugs or sells or solicits a controlled substance in that setting, or inflicts serious bodily injury on another person in that setting. The definitions of those terms are cross-references and were not opened. The lawyer decides manifestation. The tool only lines up dates. |
