| How AI is used | From the position description and the provider's status, list whether the provider is a registered NDIS provider or a state-funded Queensland disability provider, and whether the role is described as risk-assessed or key personnel. Do not decide that a clearance is required. |
| What the lawyer must review | You decide whether the provider is a registered NDIS provider or a state-funded disability provider. You decide whether this role needs a clearance. The tool does not. If a clearance is required, the worker does not start until it is issued. A pending check is not enough. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer decides if this Queensland role needs a clearance before the first shift.

- What the AI does: From the position description and the provider's status, list whether the provider is a registered NDIS provider or a state-funded Queensland disability provider, and whether the role is described as risk-assessed or key personnel. Do not decide that a clearance is required.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Record the provider's registration or state-funded status from the documents.
2. Record the role description. Do not re-label it.
3. Leave the start-work answer for the lawyer.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- The NDIS Commission says an NDIS worker screening check is required for an employee, volunteer, contractor or student of a registered provider in a risk-assessed role or a key personnel role, or where the registered or unregistered provider has decided that its workers will be screened, and for some sole traders. The check is done by the worker screening unit where the person lives.
- Queensland Disability Worker Screening says a person working or volunteering with a registered NDIS provider or a state-funded disability provider may need a clearance. If a clearance is required, the person cannot start until it is issued. The employer must verify the engagement before the application is valid.

## Practical guide

Jurisdiction: Who needs a Queensland disability worker screening clearance

**Deliverable**: A role note for the lawyer, with no start-work decision.

**Inputs**

- The position description
- The provider's registration status
- Who engages the worker

**Example**: Illustrative example: The provider is state-funded and not an NDIS registered provider. The note records that status and the role title. It does not say the worker can start on a pending application.

**Stop and escalate when**

- The provider's status is not in the papers.
- The output would tell the worker they may start.
