| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the application and the instructions, record which of section 42(2), 42(3) or 42(4) of the Defence Regulations 2026 the application uses, the date it was made, whether 14 days or 60 days have passed without a decision, and whether an interim direction is sought. List any requirement in a draft direction that is not one of the examples in section 45(4). Do not draft the direction or the application. |
| What the lawyer must review | The lawyer decides whether the applicant can apply, whether an interim direction meets section 44 or a final direction meets section 45, whether section 43(3) is a reason not to deal with the application, and whether to seek review under section 46. The lawyer writes the advice and any application or request for review. Eligible defence member takes its meaning from the Defence Force Discipline Act 1982, which the lawyer reads. The Fair Work Act provisions named in the regulations are applied only after the lawyer reads them. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the application and the instructions, record which of section 42(2), 42(3) or 42(4) of the Defence Regulations 2026 the application uses, the date it was made, whether 14 days or 60 days have passed without a decision, and whether an interim direction is sought. List any requirement in a draft direction that is not one of the examples in section 45(4). Do not draft the direction or the application.
- What the lawyer does: The lawyer decides whether the applicant can apply, whether an interim direction meets section 44 or a final direction meets section 45, whether section 43(3) is a reason not to deal with the application, and whether to seek review under section 46. The lawyer writes the advice and any application or request for review. Eligible defence member takes its meaning from the Defence Force Discipline Act 1982, which the lawyer reads. The Fair Work Act provisions named in the regulations are applied only after the lawyer reads them.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm the route is one of section 42(2), 42(3) or 42(4), and that the facts match that route.
2. If 60 days have passed with no decision, confirm the advice deals with the deemed refusal in section 43(6).
3. For an interim direction, confirm both limbs of section 44(2) and the limits in section 44(5) are addressed.
4. For a final direction, confirm both limbs of section 45(1)(b) are addressed.
5. If review is sought, confirm the request is in writing and within 21 days, and that section 46(5) is addressed if 60 days pass with no review decision.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
