## Key facts

| Fact | Value |

| Practice area | [Military & Defence Law](https://ailawframework.com/practice/military-and-defence-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the notice and its attachments, extract the stated reason, the facts and circumstances set out, the date the notice was given, and the period allowed for a written response. List which of the reasons in section 23(1) of the Defence Regulations 2026 the notice relies on, and whether the notice contains each item section 32(2) requires. Do not draft the member's response. |
| What the lawyer must review | The lawyer decides whether section 23 applies, whether an exception in section 23(4) is relied on, whether the reason is made out (including section 5(2) where the reason is the interests of the Defence Force, and section 24 where the reason is sexual violence), and writes the advice and any written response. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the notice and its attachments, extract the stated reason, the facts and circumstances set out, the date the notice was given, and the period allowed for a written response. List which of the reasons in section 23(1) of the Defence Regulations 2026 the notice relies on, and whether the notice contains each item section 32(2) requires. Do not draft the member's response.
- What the lawyer does: The lawyer decides whether section 23 applies, whether an exception in section 23(4) is relied on, whether the reason is made out (including section 5(2) where the reason is the interests of the Defence Force, and section 24 where the reason is sexual violence), and writes the advice and any written response.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Check the extracted reason and dates against the notice, including the date it was given.
2. Confirm whether section 23(4) is said to remove the notice requirement, and that the common-law note in that subsection has been considered.
3. If sexual violence is a reason, confirm the notice states that reason, as section 23(3) requires, and that section 24 has been read.
4. Confirm the response invites any relevant mental health evidence, which section 32(2)(d) says the notice must invite.
5. Confirm no classified or restricted material was put into the tool.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
