| What the lawyer must review | 49 CFR section 396.9, as displayed on the Cornell page opened on 22 October 2026, authorizes every special agent of the Federal Motor Carrier Safety Administration to inspect motor-carrier vehicles in operation and intermodal equipment in operation. The Driver Vehicle Examination Report records the results. Authorized personnel declare and mark out of service any motor vehicle or intermodal equipment which by reason of its mechanical condition or loading would likely cause an accident or a breakdown, using an Out-of-Service Vehicle sticker. No motor carrier or intermodal equipment provider shall require or permit any person to operate it, and no person shall operate it, until all repairs required by the out-of-service notice have been satisfactorily completed. The opened text treats towing as operation, except towing away by a crane or hoist, and then continues into a vehicle-combination sentence that was cut off on the page. Read the rest of subsection (c)(2) before you rely on any other towing exception. No person removes the sticker before those repairs are complete. The driver delivers the report to the motor carrier and the intermodal equipment provider at the next terminal or facility, or transmits it immediately if the driver will not arrive within 24 hours. Within 15 days after the inspection the carrier or provider certifies that all violations noted have been corrected by completing the signature portion of the form, returns the form if the issuing state agency requests it, and retains a copy for 12 months. Section 396.11(a)(3), which states how violations are corrected, was not opened. The certification is signed. You write it. Cornell is not the official CFR. There is no improvement notice in this section. |

## Checking plan

- What the AI does: Copy the defects the Driver Vehicle Examination Report already states, and record whether the report marks the vehicle or the intermodal equipment out of service. Write no certification and no signature block.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not clear the vehicle. The certification is the carrier official signature, and you write it.
- Confirm the section in the official CFR. The Cornell page shows amendments through 22 June 2026.
