## Key facts

| Fact | Value |

| Practice area | [Legal Aid & Community Legal Practice](https://ailawframework.com/practice/legal-aid-and-community-legal-practice.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Mark names, addresses, dates of birth, file numbers, and unique facts that would identify the client, and propose what to remove. Write no sentence of the report. |
| What the lawyer must review | You decide what is sent. Model Rule 1.6(a) prohibits revealing information relating to the representation unless the client gives informed consent, the disclosure is impliedly authorised in order to carry out the representation, or paragraph (b) permits it. Rule 1.6(c) requires reasonable efforts to prevent inadvertent or unauthorised disclosure or access. Removing a name is not informed consent. ABA Formal Opinion 512 says informed consent is required before inputting information relating to the representation into a generative tool that will not keep it confidential, and that a lawyer must not assume a tool keeps the information confidential. Under 45 CFR § 1620.2, a case is service to specific clients. A report that uses case facts is still information relating to a representation until you have a basis in Rule 1.6 to reveal it. You check every example before it leaves the program. |

## Checking plan

- What the AI does: Mark names, addresses, dates of birth, file numbers, and unique facts that would identify the client, and propose what to remove. Write no sentence of the report.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not treat de-identification as consent. Rule 1.6(a) still requires a ground before the fact is revealed.
- Do not send the unmarked file to a funder, or put it into a tool whose terms were not read, in order to produce the redacted version.
