## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Knowledge Management](https://ailawframework.com/practice/knowledge-management.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | List names, matter numbers, unique figures and other identifiers in the document for the lawyer to remove or generalise. Do not write the bank version. |
| What the lawyer must review | Model Rule 1.6(a) prohibits revealing information relating to the representation unless the client gives informed consent, the disclosure is impliedly authorised to carry out the representation, or an exception in paragraph (b) applies. Rule 1.6(c) requires reasonable efforts to prevent inadvertent or unauthorised disclosure of, or unauthorised access to, that information. Formal Opinion 512 says informed consent is required before inputting information relating to the representation into a generative tool that will not keep it confidential, and that consent requires an explanation of the risks and who will have access. Removing a name is not anonymisation if the transaction can still be recognised. You decide what may enter the bank and whether client consent is required. You write the bank version. |

## Checking plan

- What the AI does: List names, matter numbers, unique figures and other identifiers in the document for the lawyer to remove or generalise. Do not write the bank version.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Opinion 512 distinguishes tools where Rule 1.6 does not require consent because no information relating to the representation is input. Read the tool's terms before using that distinction.
- Privilege is a separate question from Rule 1.6. A document can be confidential under the rule and still be outside the privilege.
