Precedent banks, clause libraries, matter knowledge and practice notes for Australian firms.

Tasks for using AI on the firm’s own knowledge, with the confidentiality, privilege, retention and review checks that sit beside them.

## Key facts

- Tasks: 30
- Green: 14, Yellow: 15, Red: 1
- Levels: Green is AI drafts and the lawyer checks; Yellow is lawyer and AI draft together; Red is the lawyer writes and AI may only check, clarify or collect data.

## Principles

- **The bank is the firm’s**: A precedent or clause is reused only when a lawyer has approved that version. An AI suggestion does not update the bank.
- **Confidential material stays out of a public tool**: Anonymise a client document before it is added to shared know-how, and do not paste privileged material into an open tool.
- **Open the source**: An answer retrieved from firm knowledge is a pointer. The lawyer opens the document it came from before relying on it.

## Checklist

- Confirm whether this item may be used with the chosen AI tool.
- Keep confidential and privileged material out of a public or open tool.
- Open the source document before relying on a retrieved answer.
- Record the reviewer and the review date.

## Restrictions

- These tasks do not approve a product and do not record that the work on a matter is done.

## Jurisdiction note

Written for Australian firms first. Name the court before applying a practice note, and confirm the current instrument.

## Basis

Checked against the linked public sources on 10 October 2026. Confirm the current instrument before reliance.

## Review checklist

- Confirm whether the precedent, clause or know-how may be used with the chosen AI tool, and which tools are permitted.
- Keep confidential and privileged material out of a public or open tool.
- Open the source document before relying on an answer retrieved from firm knowledge.
- Record who reviewed the item and the review date.
- Place the item on the firm’s retention schedule and confirm where the copy is stored.

## Limits on AI assistance

AI may search, group and draft a markup of firm knowledge. It may not decide that a precedent is current, that privilege is intact, or that a client has agreed to the use. Those decisions stay with the lawyer.
