| How AI is used | List each ground the lawyer names and the facts in the selected documents, with the document and the page. Write no statement of grounds and no filing. |
| What the lawyer must review | You choose the grounds and you write the opposition. Section 1063 says any person who believes that he would be damaged by the registration of a mark on the principal register, including dilution by blurring or tarnishment under section 1125(c), may, upon payment of the prescribed fee, file an opposition stating the grounds, within thirty days after the publication under section 1062(a). Upon written request before the thirty-day period expires, the time for filing is extended for an additional thirty days. Further extensions may be granted by the Director for good cause when requested before the extension expires. The Director shall notify the applicant of each extension. You read section 1125(c) before you use dilution as a ground. Section 1052(d) refuses registration of a mark which so resembles a mark registered in the Office, or a mark or trade name previously used in the United States by another and not abandoned, as to be likely, when used on or in connection with the goods of the applicant, to cause confusion, or to cause mistake, or to deceive. The subsection contains a proviso on concurrent registration. You read that proviso before you apply the resemblance test. You do not count grounds to compute a fee, and you do not use a two-month opposition period. |
