| How AI is used | From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index for a proceeding on the contract. The tool writes nothing that will be filed. |
| What the lawyer must review | The lawyer writes every document that will be filed. The tool does not. Diary six years under section 5(1)(a) only after subsections (1AAA), (1AA) and (1A) are read. Apply Practice Note SC GEN 25 if the proceeding is in the Supreme Court. Do not put medical records into a public tool. |

## Checking plan

**Lawyer-led judgement**

The lawyer writes every document that will be filed. The tool may only index.

- What the AI does: From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index for a proceeding on the contract. The tool writes nothing that will be filed.
- What the lawyer does: Choose the court, apply that court's generative artificial intelligence rule, and diary the contract limitation that matches the pleading.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 5(1)(a) of the Limitation of Actions Act 1958 (Vic), subject to subsections (1AAA), (1AA) and (1A), covers an action founded on simple contract, including contract implied in law, and the period is six years from accrual.
2. Practice Note SC GEN 25 was issued and commenced on 14 May 2026. Paragraph 6.1: court users are responsible for the content of court documents whether or not artificial intelligence was used.
3. Paragraph 6.8 says court users should not enter confidential or sensitive information, including information subject to a non-publication or suppression order, into a public artificial intelligence tool. Paragraph 6.10 requires particular caution where a generative tool assists with affidavit material, a witness statement, or another document that is a witness's evidence. Paragraph 6.12 requires particular caution for an expert report, which must comply with the relevant code of conduct or practice note. The footnote identifies Form 44A of the Supreme Court rules.
4. Paragraph 7.1: content produced using artificial intelligence must be verified with meaningful human control.
5. This version does not choose the court. The practice note applies when the proceeding is in the Supreme Court of Victoria.

## Notes

- Read subsections (1AAA), (1AA) and (1A) before relying on the six years. This version does not state what they contain.
- Keep medical and wage records in the firm's tool. Rule 9 of the uniform solicitors' conduct rules and Australian Privacy Principle 11 apply. A loss likely to result in serious harm may be notifiable.

## Practical guide

Jurisdiction: Supreme Court of Victoria, if that is where the contract claim is issued

**Deliverable**: An issues index and a document index. The lawyer writes the filed documents.

**Inputs**

- Policy and decision letters
- Approved date table
- How the claim will be pleaded

**Example**: Illustrative example: The index lists the policy definition and the decision dates. The lawyer writes the originating process. The tool does not prepare the evidence or an expert report.

**Stop and escalate when**

- A document that will be filed is still attributed to the tool.
- The proceeding is in the Supreme Court and Practice Note SC GEN 25 has not been applied.

Checked 2026-10-23.
