## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Insurance Law](https://ailawframework.com/practice/insurance-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed. |
| What the lawyer must review | The lawyer writes every document that will be filed. The tool does not. Use section 10(1)(a) only where the damages do not include personal injury. Name the practitioner under Practice Direction 5 of 2025 if Supreme Court submissions are filed. Have the named practitioner verify every reference. A firm name is not enough. |

## Checking plan

**Lawyer-led judgement**

The lawyer writes every document that will be filed. The tool may only index.

- What the AI does: From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed.
- What the lawyer does: Choose the court, apply that court's generative artificial intelligence rule, and diary the contract limitation that matches the pleading.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 10(1)(a) of the Limitation of Actions Act 1974 (Qld), subject to section 10AA, gives six years only where the damages claimed do not consist of or include damages in respect of personal injury. Section 10(3) gives six years for a deed, and section 10(3A) preserves any shorter period.
2. Practice Direction 5 of 2025 requires the individual legal practitioner responsible for written submissions to be named. Naming the firm is not enough.
3. By being named, that practitioner informs the Court that they have verified the accuracy and relevance of references to legislation, authorities and other sources, and that the submissions reflect their judgement on their professional obligations.
4. The direction is about written and oral submissions. It does not set a rule for expert reports.
5. This version does not choose the court. Check the practice direction of the court in which the claim is filed.

## Notes

- Read section 10AA before relying on section 10(1)(a). If the pleading includes personal-injury damages, section 10(1)(a) does not apply to that part.
- Keep medical and wage records in the firm's tool. Queensland uses the Australian Solicitors' Conduct Rules 2023. Australian Privacy Principle 11 applies, and a loss likely to result in serious harm may be notifiable.

## Practical guide

Jurisdiction: Supreme Court of Queensland, if that is where the contract claim is issued

**Deliverable**: An issues index and a document index. The lawyer writes the filed documents.

**Inputs**

- Policy and decision letters
- Approved date table
- How the claim will be pleaded

**Example**: Illustrative example: The tool prepares the issues index. The lawyer writes the submissions and puts the individual practitioner's name on them. The firm name alone is not used.

**Stop and escalate when**

- Written submissions name the firm and not the individual practitioner.
- Section 10(1)(a) has been applied to a claim that includes personal-injury damages.

Checked 2026-10-23.
