## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Insurance Law](https://ailawframework.com/practice/insurance-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed. |
| What the lawyer must review | The lawyer writes every document that will be filed. The tool does not. Diary six years under section 14(1)(a) only for a contract that is not a deed. Apply Practice Note SC Gen 23 if the proceeding is in the Supreme Court. You may generate an index. Obtain prior leave for an expert report. |

## Checking plan

**Lawyer-led judgement**

The lawyer writes every document that will be filed. The tool may only index.

- What the AI does: From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed.
- What the lawyer does: Choose the court, apply that court's generative artificial intelligence rule, and diary the contract limitation that matches the pleading.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 14(1)(a) of the Limitation Act 1969 (NSW) gives six years from first accrual for contract, including quasi-contract, not being a deed. Section 14 does not apply to section 19 or to contribution under section 26.
2. Practice Note SC Gen 23 was issued on 28 January 2025 and commenced on 3 February 2025. Paragraph 9B allows generation of chronologies, indexes and witness lists, subject to paragraph 9A.
3. Paragraph 9A: information under a suppression order, produced on subpoena, or under a statutory publication ban must not be entered into a generative artificial intelligence program unless the confidentiality conditions in that paragraph are met.
4. Paragraph 10: generative artificial intelligence must not generate the content of affidavits, witness statements, character references or other material intended to reflect evidence or opinion. Paragraph 20: it must not draft an expert report without prior leave.
5. This version does not choose the court. The practice note applies when the proceeding is in the Supreme Court of New South Wales.

## Notes

- A deed is outside section 14(1)(a). Read the deed provision before a deed is diarised.
- Keep medical and wage records in the firm's tool. Rule 9 of the uniform solicitors' conduct rules and Australian Privacy Principle 11 apply. A loss likely to result in serious harm may be notifiable.

## Practical guide

Jurisdiction: Supreme Court of New South Wales, if that is where the contract claim is issued

**Deliverable**: An issues index and a document index. The lawyer writes the filed documents.

**Inputs**

- Policy and decision letters
- Approved date table
- How the claim will be pleaded

**Example**: Illustrative example: The tool prepares the issues index from the approved date table. The lawyer writes the originating process. No expert report is prepared without prior leave.

**Stop and escalate when**

- Material produced on subpoena would be entered into a public tool.
- An expert report is being prepared and prior leave has not been obtained.

Checked 2026-10-23.
