## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Insurance Law](https://ailawframework.com/practice/insurance-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed with a court. |
| What the lawyer must review | The lawyer writes every document that will be filed. The tool does not. Choose the court and apply that court's generative artificial intelligence practice note. Check the limitation period for a contract claim, and any personal-injury period. Do not put the client's medical records into a public tool. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the policy, the decision letters and the date table the lawyer has approved, build an issues index and a document index. The tool writes nothing that will be filed with a court.
- What the lawyer does: The lawyer writes every document that will be filed. The tool does not. Choose the court and apply that court's generative artificial intelligence practice note. Check the limitation period for a contract claim, and any personal-injury period. Do not put the client's medical records into a public tool.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer writes every document that will be filed. The tool writes nothing that is filed.

## Checks the lawyer makes

1. Rule D.1.3: there is no monetary limit on the remedies for a superannuation complaint. A direct complaint is subject to the section D caps in the rules dated 8 October 2026.
2. Rule D.4.2: those caps are adjusted on 1 January 2021 and every three years after that. The table for complaints submitted on or after 1 January 2024 is the one in the 8 October 2026 rules.
3. Rule B.4.4.1: the superannuation disability time limits cannot be extended. That is a usual reason a proceeding is considered.
4. Diary the state limitation period in the versions. Section 57 interest, if the insurer is liable, runs from the day it was unreasonable to withhold payment, at the rate in the regulations.
5. Apply Practice Note SC GEN 25 in Victoria, Practice Note SC Gen 23 in New South Wales, or Practice Direction 5 of 2025 in Queensland, to anything prepared for that court.

## Notes

- Medical, wage and claim records stay in a firm-controlled tool. ASCR r 9 and Australian Privacy Principle 11 apply. A loss or unauthorised disclosure that is likely to result in serious harm may be notifiable under the Privacy Act 1988 (Cth).
- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts.
