## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Insurance Law](https://ailawframework.com/practice/insurance-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the policy offset clause and the payment summaries the lawyer selects, build a table of each amount, its source, the period, and whether the clause picks it up. The tool does not decide a deduction the clause does not name. |
| What the lawyer must review | Read the offset clause. Apply it only to amounts the clause names. Match each payment to weekly payments, loss of earnings, paid leave or other income. Check the arithmetic against the payment summaries, not the client's memory. Keep medical and wage records in the firm's tool. ASCR r 9 and APP 11 apply. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to the policy, the fund records and the linked primary sources, and check for material the output has missed.

- What the AI does: From the policy offset clause and the payment summaries the lawyer selects, build a table of each amount, its source, the period, and whether the clause picks it up. The tool does not decide a deduction the clause does not name.
- What the lawyer does: Read the offset clause. Apply it only to amounts the clause names. Match each payment to weekly payments, loss of earnings, paid leave or other income. Check the arithmetic against the payment summaries, not the client's memory. Keep medical and wage records in the firm's tool. ASCR r 9 and APP 11 apply.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Quote the offset clause from the schedule or the policy wording. Do not use a generic list of offsets.
2. Keep WorkSafe, SIRA and WorkSafe Queensland weekly payments in separate rows from any transport payment.
3. Section 3.6 of the Motor Accident Injuries Act 2017 (NSW) is the first 13 weeks only. Do not treat it as the whole of the statutory-benefits period without reading the later sections.
4. Victorian loss of earnings benefits are fortnightly and, on the Commission's policy, cover the first 18 months.
5. Clause 5.17 lets a subscribing insurer ask for financial information to assess entitlement or to confirm the amount. The offset is still the words of the policy.

## Notes

- Medical, wage and claim records stay in a firm-controlled tool. ASCR r 9 and Australian Privacy Principle 11 apply. A loss or unauthorised disclosure that is likely to result in serious harm may be notifiable under the Privacy Act 1988 (Cth).
- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts.
