## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Insurance Law](https://ailawframework.com/practice/insurance-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Copy into a fixed table the amount paid or accepted, the date of the claim, the date of any denial, and the date of payment. If the contract is a workers' compensation or motor-accident contract, label the row as outside section 57. Do not choose a start day and do not apply a rate. |
| What the lawyer must review | Do not let the table be used as a section 57 calculation until you decide that section applies. If the payment is workers' compensation or motor-accident insurance, you name the interest rule. You choose the day withholding became unreasonable. The tool does not apply a rate. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The tool copies payment dates. The lawyer decides whether section 57, or a Queensland rule, governs interest.

- What the AI does: Copy into a fixed table the amount paid or accepted, the date of the claim, the date of any denial, and the date of payment. If the contract is a workers' compensation or motor-accident contract, label the row as outside section 57. Do not choose a start day and do not apply a rate.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Copy only dates and amounts that appear in the file.
2. Label a Workers' Compensation and Rehabilitation Act or Motor Accident Insurance Act payment as outside section 57.
3. Leave the rate and the start day blank.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Section 57 of the interest rule is in the Insurance Contracts Act 1984 (Cth), not the Motor Accident Insurance Act 1994. Section 9(1)(e) takes outside that Act a contract entered for a workers' compensation law, or for compensation for death or injury arising out of the use of a motor vehicle. Motor Accident Insurance Act section 42 is payment of private hospital, medical and pharmaceutical expenses once liability is admitted. Subsection (3) is about treatment, care and support needs. Neither states an interest rate, and none is entered.

## Practical guide

Jurisdiction: Interest on a Queensland insurance or scheme payment

**Deliverable**: A date-and-amount table with the interest statute left for the lawyer.

**Inputs**

- The payment record
- The policy or scheme
- Any denial letter

**Example**: Illustrative example: The insurer paid $4,200 on 1 June 2026 for treatment. The table records that date and the amount. The interest cell is blank because the policy is a CTP policy.

**Stop and escalate when**

- The payment is a workers' compensation or motor-accident payment and a dollar figure of interest is requested.
- The date of payment is not in the file.
