## Key facts

| Fact | Value |

| Practice area | [Immigration & Migration Law](https://ailawframework.com/practice/immigration-and-migration-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | Index each country report with its publisher, date and the page the lawyer marked. List the documents supplied. Write no sentence of the Form I-589 narrative, the personal statement or any declaration. |
| What the lawyer must review | USCIS says an eligible person files Form I-589, Application for Asylum and for Withholding of Removal, within one year of arrival, affirmatively or defensively. From 21 August 2026, supporting evidence for an affirmative asylum interview must be submitted 14 calendar days before the interview, or USCIS may leave it out or reschedule. The account of persecution is the applicant's. EOIR Policy Memorandum 25-40 (8 August 2025) has no blanket ban and no mandatory disclosure of generative AI in Immigration Court or before the Board, but an individual judge may adopt a standing order. 8 C.F.R. § 1003.102(c) reaches a practitioner who knowingly or with reckless disregard offers false evidence. You open every citation before it is filed. |

## Checking plan

- What the AI does: Index each country report with its publisher, date and the page the lawyer marked. List the documents supplied. Write no sentence of the Form I-589 narrative, the personal statement or any declaration.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- A missed affirmative interview can lead to dismissal or referral. Read the 21 August 2026 notices on the USCIS asylum page before calendaring.
- PM 25-40 does not create a right. It tells practitioners to confirm citations and, where the Model Rules require it, to consult the client.
