| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the services the lawyer has named, draft the request for the date range the lawyer has set, naming the access path and the response time that path states. Do not collect anything from a My Health Record system. Leave the request as a draft. |
| What the lawyer must review | The lawyer chooses the path and sends the request. A private body has 45 days for access and 30 days for correction. Do not quote the Freedom of Information Act 1982. The Commissioner names the path, and that Act was not opened. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The Health Complaints Commissioner states a maximum of 45 days for a private-sector access request and 30 days for a correction request. Public-sector records are on the Freedom of Information path.

- What the AI does: From the services the lawyer has named, draft the request for the date range the lawyer has set, naming the access path and the response time that path states. Do not collect anything from a My Health Record system. Leave the request as a draft.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. For a private-sector organisation, name the Health Records Act path the Commissioner describes, and the 45-day access maximum or the 30-day correction maximum.
2. For a Victorian Government or other public-sector body, including a public hospital, follow the Freedom of Information path the Commissioner states. Informal release is also mentioned under the Health Services Act 1988 and the Health Records Act 2001. Those Acts were not opened.
3. The Commissioner says fees are capped by the Health Records Regulations 2023 and the page sets out more than one fee-unit figure. The lawyer checks which period applies. No dollar figure is taken from the page into the request.
4. Do not collect records from a My Health Record system. That Act was not opened for this version.

## Notes

- The Commissioner says a private organisation cannot erase incorrect information. Correction is a separate task. The draft is not sent until the lawyer sends it.
- If this is filed in the Supreme Court of Victoria, Practice Note SC Gen 25, issued on 14 May 2026, calls for particular caution with affidavit material and expert reports, and says confidential information should not go into a public AI tool.

## Practical guide

Jurisdiction: Victoria. A request for the patient's health records.

**Deliverable**: A draft request for each holder, for the lawyer to send.

**Inputs**

- Services the lawyer has named
- The date range the lawyer has set
- Whether the holder is a private organisation or a public-sector body

**Example**: Illustrative example: One holder is a private clinic and one is a public hospital. The draft uses 45 days for the clinic and the public-sector path for the hospital. It is not sent.

**Stop and escalate when**

- The holder's sector is unknown.
- The tool is asked to collect a My Health Record.

Checked 2026-10-23.
