| Fact | Value |

| Practice area | [Health & Medical Law](https://ailawframework.com/practice/health-and-medical-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the services the lawyer has named, draft the request for the patient's own records to the Right to Information decision-maker at the Hospital and Health Service, and say what authority an agent must provide. Leave the request as a draft. |
| What the lawyer must review | The lawyer sends the request and decides whether consent is held. If consent for someone else's records cannot be obtained, make a Right to Information application. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

Queensland Health says a person, or an agent for a patient, may apply under the administrative access scheme by contacting the Right to Information decision-maker at the Hospital and Health Service.

- What the AI does: From the services the lawyer has named, draft the request for the patient's own records to the Right to Information decision-maker at the Hospital and Health Service, and say what authority an agent must provide. Leave the request as a draft.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. For the patient's own records, or an agent acting for the patient, use the administrative access scheme and the decision-maker at the Hospital and Health Service.
2. An agent provides evidence of authority and of identity. Queensland Health asks for a certified copy of the patient's evidence of identity and for authority signed and dated by the person.
3. If consent cannot be obtained for someone else's records, Queensland Health says a Right to Information application is required. The Right to Information Act 2009 is the formal Act. Its text was not opened.
4. Do not collect records from a My Health Record system. That Act was not opened.

## Notes

- Amendment of a record is a separate task on the same page. This request is for access.
- The Queensland Courts generative AI page says the user is responsible for accuracy of what is given to a court or tribunal, and that private, confidential, suppressed or legally privileged information must not go into a generative AI chatbot. Practice Direction 5 of 2025 is listed. Its text was not opened.

## Practical guide

Jurisdiction: Queensland. A request for health records held by Queensland Health.

**Deliverable**: A draft access request, for the lawyer to send.

**Inputs**

- The Hospital and Health Service the lawyer names
- Whether the requester is the patient or an agent
- The date range

**Example**: Illustrative example: The lawyer acts for the patient and holds a signed authority. The draft is addressed to the decision-maker at the service and attaches nothing until the lawyer adds the authority.

**Stop and escalate when**

- Consent for another person's records is missing.
- The tool is asked to send the request.

Checked 2026-10-23.
