## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Health & Medical Law](https://ailawframework.com/practice/health-and-medical-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Set out the section 22 words against the division in the registration extract, including rejection where the opinion is irrational or contrary to a written law. Do not add the words in Australia, and do not decide breach. |
| What the lawyer must review | Decide whether the field is the recorded division. Keep a warning allegation under section 22(5), outside section 22. Check that the words in Australia have not been added to section 22(1). Keep health information in a firm-controlled tool, not a public one. |

## Checking plan

**Verify against sources**

The division is recorded. Section 22 is set out beside it without adding words the subsection does not use.

- What the AI does: Set out the section 22 words against the division in the registration extract, including rejection where the opinion is irrational or contrary to a written law. Do not add the words in Australia, and do not decide breach.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Record the division the register shows, using the five divisions named in the guideline.
2. Set out section 22(1): widely accepted by peer professional opinion by a significant number of respected practitioners in the field as competent professional practice. Do not add the words in Australia.
3. Record that the opinion cannot be relied on if the court considers it irrational or contrary to a written law.
4. Keep a warning, advice or other information allegation under section 22(5).
5. The lawyer decides the field. Do not treat the division table as a finding on breach.

## Notes

- Continuing professional development does not change the division.
- The medication and radiography laws named on the guideline page were not opened.
- Health information stays in a firm-controlled tool. The Australian Solicitors' Conduct Rules 2023 came into force in Queensland on 27 September 2024. The Queensland Law Society page says Queensland adopted the majority of the Uniform Law changes and does not list confidentiality among the rules it kept in 2012 wording. APP 11 applies. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland. A dental treatment allegation. The peer words are section 22. A warning stays under section 22(5).

**Deliverable**: The recorded division, with the section 22 words set out beside it.

**Inputs**

- Registration extract showing the division
- The allegation, marked as treatment or as a warning
- The section 22 text

**Example**: Illustrative example: The register records a dental prosthetist. The draft says the peer practice was widely accepted in Australia. The lawyer removes those added words. The tool does not decide the field.

**Stop and escalate when**

- The words in Australia have been added to section 22(1).
- A warning row is placed under section 22.
