| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the passage the lawyer has marked and the correction the lawyer has settled, draft a request that asks the private-sector holder to correct the record or, if it will not, to store the written statement with the record. State a maximum of 30 days. Do not assert that the record is wrong. |
| What the lawyer must review | The lawyer settles the words said to be wrong. The draft does not assert the record is wrong. Use 30 days for a private-sector correction. A public-sector correction section was not opened. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The Commissioner says a private-sector holder has a maximum of 30 days to respond to a correction request, cannot erase the incorrect information, and must store the written statement if it refuses.

- What the AI does: From the passage the lawyer has marked and the correction the lawyer has settled, draft a request that asks the private-sector holder to correct the record or, if it will not, to store the written statement with the record. State a maximum of 30 days. Do not assert that the record is wrong.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Ask for a correction, or for the written statement to be stored. Do not ask the holder to erase the incorrect information.
2. State the maximum of 30 days for a correction request. Do not use the 45-day access figure.
3. If the holder corrects the information, the page says it must notify any other provider it shared the information with.
4. A private health service provider cannot delete the information until seven years after the last service, or, if the person was last treated under 18, until the person has reached 25.

## Notes

- The Commissioner says a correction request is not charged. A public-sector correction rule was not opened. Non-health service providers must delete health information if it is no longer needed. Do not apply the seven-year period to them.
- If this is filed in the Supreme Court of Victoria, Practice Note SC Gen 25, issued on 14 May 2026, calls for particular caution with affidavit material and expert reports, and says confidential information should not go into a public AI tool.

## Practical guide

Jurisdiction: Victoria. A correction request to a private-sector holder of health information.

**Deliverable**: A draft correction request, or a request that the statement be stored with the record.

**Inputs**

- The passage the lawyer has marked
- The correction wording the lawyer has settled
- Whether the holder is a private-sector organisation

**Example**: Illustrative example: The note records one dose and the instructions the lawyer has settled ask for a different dose. The draft asks the holder to correct that entry or to store the statement, and it states 30 days. It does not say the note is wrong.

**Stop and escalate when**

- The holder is a public-sector body. A correction section for that path was not opened.
- The tool is asked to say the record is wrong.
