| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the passage the lawyer has marked and the amendment the lawyer has settled, draft a request that asks the holder to amend the health information or, if it will not, to attach the statement of the amendment sought so it can be read with the information. Do not state a number of days. Do not assert that the record is wrong. |
| What the lawyer must review | The lawyer settles the words. The draft asks for an amendment or for the statement to be attached. Principle 8 states no number of days. Do not copy a 30-day correction period. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

Health Privacy Principle 8 requires appropriate amendments so the information is accurate and, having regard to the purpose of collection, relevant, up to date, complete and not misleading. No number of days is stated.

- What the AI does: From the passage the lawyer has marked and the amendment the lawyer has settled, draft a request that asks the holder to amend the health information or, if it will not, to attach the statement of the amendment sought so it can be read with the information. Do not state a number of days. Do not assert that the record is wrong.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Ask for corrections, deletions or additions so the information is accurate and, having regard to the purpose of collection or use and any directly related purpose, relevant, up to date, complete and not misleading.
2. If the draft assumes the holder will not amend, ask it to take reasonable steps to attach the statement so it can be read with the information.
3. If the information is amended, the individual is entitled, if reasonably practicable, to have recipients notified.
4. State no number of days. Principle 8(4) says compliance is not required where the holder is lawfully authorised or required not to comply, or where another law permits non-compliance, including the State Records Act 1998.

## Notes

- The schedule note says amendment of health information held by public sector agencies may also be sought under the Privacy and Personal Information Protection Act 1998. That Act was not opened. Division 4 of Part 4, for private sector persons, was not opened as operative text.
- If this is filed in the Supreme Court of New South Wales, Practice Note SC Gen 23, issued on 28 January 2025 and commenced on 3 February 2025, bars generative AI from the content of an affidavit or witness statement, and from an expert report without prior leave, subject to paragraph 23.

## Practical guide

Jurisdiction: New South Wales. A request to amend health information under Health Privacy Principle 8.

**Deliverable**: A draft amendment request, including a request to attach the statement if the holder will not amend.

**Inputs**

- The passage the lawyer has marked
- The amendment wording the lawyer has settled

**Example**: Illustrative example: The note records one date and the lawyer has settled a different date. The draft asks for that amendment and, if refused, for the statement to be attached. It states no number of days.

**Stop and escalate when**

- The tool is asked to insert a number of days.
- The tool is asked to say the record is wrong.
