| How AI is used | From FAR 42.302, copy only the functions the contracting officer marks as delegated or retained, with the paragraph number as printed. Do not decide the delegation and do not add a function the contracting officer did not mark. |
| What the lawyer must review | FAR 42.302(a) provides that the contracting officer normally delegates the contract administration functions listed in that subsection to a contract administration office, and may retain any of those functions except those in paragraphs (a)(5), (a)(9), (a)(11), and (a)(12), unless the cognizant federal agency has designated the contracting officer to perform them. Paragraph (b) provides that the contract administration office shall perform the functions listed there only when and to the extent specifically authorized by the contracting office. Paragraph (c) provides that any additional contract administration function not listed in paragraphs (a) and (b), or not otherwise delegated, remains the responsibility of the contracting office. The content of paragraphs (a)(9), (a)(11), and (a)(12) was not opened beyond that exception. ABA Formal Opinion 512 (29 July 2024) leaves the lawyer responsible for the plan. The contracting officer decides the delegation. The list does not. |

## Checking plan

- What the AI does: From FAR 42.302, copy only the functions the contracting officer marks as delegated or retained, with the paragraph number as printed. Do not decide the delegation and do not add a function the contracting officer did not mark.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- A function left unmarked is not recorded as delegated or as retained.
- The plan is not a delegation. The contracting officer makes that decision.
