## Key facts

| Fact | Value |

| Practice area | [Government Procurement & Tendering](https://ailawframework.com/practice/government-procurement-and-tendering.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Set the buyer's policy, as the lawyer supplies it, beside the supplier's written description of its tool. List each policy sentence the description does not address. Do not decide that the supplier meets the policy. |
| What the lawyer must review | The policy is the document the buyer supplies. ABA Model Rule 1.6(a) provides that a lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the representation, or the disclosure is permitted by paragraph (b). ABA Formal Opinion 512 (29 July 2024) applies that duty to information entered into a generative tool. During a live Federal procurement, FAR 3.104-3 prohibits knowing disclosure or obtaining of contractor bid or proposal information or source selection information before award, other than as provided by law. The lawyer reads both papers. The comparison does not approve the supplier. |

## Checking plan

- What the AI does: Set the buyer's policy, as the lawyer supplies it, beside the supplier's written description of its tool. List each policy sentence the description does not address. Do not decide that the supplier meets the policy.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Put the proposal and the policy only in the system the lawyer names.
- A sentence the description does not address is not a finding that the supplier is unacceptable.
