# Government Procurement & Tendering

> Public buying is governed by the procurement rules that apply to the entity. Software can check a draft against the version the lawyer has opened. It cannot decide that a procurement achieved value for money.

Also covers: Commonwealth Procurement Rules, approach to market, evaluation records, supplier debriefs, tendering

Finance’s public page, read on 22 September 2026, says guidance was still being updated for the 17 November 2025 rules and that current guidance may not yet include those changes. Treat an old internal checklist as unverified until you have opened the PDF that applies.

The rules contain a division for all procurements and additional rules at or above the relevant threshold, plus exemptions. Do not apply the additional rules, or skip them, until the threshold question is answered from the text.

## Key facts

- Tasks: 26
- Green: 9, Yellow: 15, Red: 2
- Levels: Green is AI drafts and the lawyer checks; Yellow is lawyer and AI draft together; Red is the lawyer writes and AI may only check, clarify or collect data.

## Principles

- **Pick the version first**: Finance has published a note on which rules apply, 1 July 2024 or 17 November 2025. Use that question before you mark a clause compliant.
- **Value for money is a judgement**: The rules aim at value for money, ethical conduct, and processes that are efficient, effective, economical, transparent and accountable. A checklist can show whether a topic was addressed. The official makes the assessment.
- **State buying is a different book**: A Commonwealth clause bank does not govern a state tender. Name the jurisdiction before you use a precedent.

## Checklist

- Record which Commonwealth Procurement Rules apply, using Finance’s “which rules apply” note, or name the state or territory regime instead.
- Check the approach to market against the division of the rules that applies at that threshold.
- Keep evaluation scores and the value-for-money conclusion with the officials who are allowed to make them.
- Draft a debrief only from the approved evaluation record.
- Compare contract departures to the clause set the lawyer has identified, not to a generic government contract.

## Restrictions

- Do not file, send or rely on generated text until the responsible lawyer has checked it against the instructions and the current source.
- Do not put suppressed, privileged, subpoenaed or safety-sensitive information into a public AI tool.

## Jurisdiction note

This page is centred on Commonwealth procurement. State and territory government tenders follow their own policies. Say which one you are in before you use a Commonwealth precedent.

## Basis

Planning guidance checked against the linked public sources on 22 September 2026. Confirm the current instrument before reliance.

## What this work is

Identify the buyer, the estimated value and the version of the rules. Then check the draft the client has. Scoring suppliers and deciding value for money stay with the people who have that role.

## Review checklist

- Record the version of the rules, or the state regime, that applies to this procurement.
- Identify whether the procurement is above the relevant threshold.
- Match each draft section you rely on to a rule you have opened.
- Do not generate evaluation scores or a value-for-money conclusion.
- Base any supplier debrief on the approved record.

## Jurisdiction-specific considerations

- The 1 July 2024 rules and the 17 November 2025 rules are both in circulation. Finance tells entities to work out which apply.
- Guidance pages may lag the PDF. Prefer the rules themselves for a requirement.
- A state tender that “looks like” a Commonwealth approach to market is still governed by that state’s policy.

## Tasks (26)

| Task | Level | How AI is used | What the lawyer must review |
| --- | --- | --- | --- |
| [Check an approach to market against the rules that apply](https://ailawframework.com/practice/government-procurement-and-tendering/check-an-approach-to-market-against-the-rules-that-apply.md) | Yellow | Extract the draft approach-to-market headings and line them up against the rule headings the lawyer has taken from the applicable procurement rules. | Open the rule cited on each row Reject a match that only shares a heading word |
| [Structure an evaluation record without scoring the bids](https://ailawframework.com/practice/government-procurement-and-tendering/structure-an-evaluation-record-without-scoring-the-bids.md) | Red | Organise the evaluation criteria and the tender excerpts the officials have tagged into a record template with empty score and comment fields. | Do not adopt a generated score or ranking Check the record contains the officials' own reasons |
| [Draft a supplier debrief from the approved evaluation record](https://ailawframework.com/practice/government-procurement-and-tendering/draft-a-supplier-debrief-from-the-approved-evaluation-record.md) | Yellow | Draft a debrief letter from the approved evaluation record, limited to the comments that record says can be shared. | Read the letter against the record Delete any comparison, score or reason the record does not authorise you to share |
| [Compare a draft contract with the clause set the lawyer supplies](https://ailawframework.com/practice/government-procurement-and-tendering/compare-a-draft-contract-with-the-clause-set-the-lawyer-supplies.md) | Yellow | Compare the draft contract with the national, state or agency clause set the lawyer has supplied, and list clauses that differ. | Open both clauses before you accept that they differ Do not treat a missing optional clause as a breach |
| Build a probity file index from the panel papers | Yellow | From the evaluation plan, conflict declarations and contact logs, list missing declarations, unlogged contacts and documents that should be on the probity file. | Treat a missing conflict declaration as a process risk Do not treat a generated index as a clearance |
| Log tenderer questions and the approved answers | Green | Turn clarification emails into a question-and-answer log, marking answers that have not been issued to all tenderers. | Confirm what was actually issued to each tenderer Treat unequal information as a process defect |
| Draft evaluation criteria and a scoring sheet from the statement of requirements | Yellow | Produce a first-draft criteria and empty scoring sheet from the approved statement of requirements, with a list of criteria that are not in the statement. | Check criteria match those published in the approach to market Do not add criteria after it is published |
| Build a tender-complaint or process-challenge chronology | Yellow | From the complaint and the evaluation file, produce a chronology of publication, closing, evaluation and decision dates, with missing documents flagged. | Decide limitation and standing yourself Do not treat the chronology as a response |

| Screen submissions for conformance and eligibility before evaluation starts | Green | Compare each submission against the mandatory requirements the lawyer has extracted from the request documentation and draft the screening table showing what… | Decide conformance, eligibility and exclusion for each submission, decide any late-lodgement question against the rules for the process, and check each… |
| Set the tender timetable and the earliest lawful closing time | Yellow | Apply the minimum-period rule and the circumstance characterisation the lawyer has selected to the calendar and draft the timetable, showing each extension… | Select the applicable rule, decide the circumstances that shorten or extend the period, and independently verify each date and time, including the time zone… |
| Build the limited tender or exemption justification record | Yellow | Work with the lawyer on the record: assemble the value, scope, market history and supporting documents, set out the condition or exemption the lawyer has… | Select the condition or exemption, decide whether the facts actually meet it rather than merely sit near it, test the value-for-money conclusion… |
| Prepare the probity plan and the conflict-of-interest register for the evaluation | Green | Populate the probity plan from the firm's validated template using the governance facts the lawyer has approved, and build the register from the returned… | Decide the management action for each declared or apparent conflict, confirm the panel composition and the delegation, decide whether a probity adviser or… |
| Check the signed probity and conflict declarations against the procurement papers | Red | Compare the returned declarations against the panel membership list, the tenderer and subcontractor lists and the register, and list who has not declared and… | Take any further declaration directly from the person concerned, decide what each undisclosed interest means for the integrity of the process, and decide… |
| Build the tenderer's compliance and departures matrix | Green | Extract every mandatory requirement, condition for participation, schedule, declaration and format rule from the request documentation into a numbered matrix,… | Settle each departure and its wording, confirm the matrix captures every mandatory requirement including those added by addenda, and check every declaration… |
| Prepare the confidentiality determination schedule for the awarded contract | Yellow | Work with the lawyer to build the schedule: list each claimed item with the supplier's stated reason and the clause or schedule it sits in, set it against… | Apply the confidentiality test to each item and decide what is genuinely confidential, check the executed contract records only what was determined, and… |
| Assess a proposed variation, extension or exercise of option against the original procurement | Green | Extract the original scope, term, options, price basis and reported contract value from the executed contract and the contract notice, set the proposed change… | Decide whether the change is within the scope and options actually contracted for or is a new procurement requiring its own process and record, check the… |
| Prepare the supplier's procurement complaint and protect the suspension | Yellow | Work with the lawyer on the complaint: assemble the process record and the correspondence, set each alleged contravention against the provision the lawyer has… | Identify the provision relied on and confirm the procurement is one the regime covers, decide the remedy and the forum, and independently confirm the… |
