| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | List the program that holds the record, whether that program is a grantee or subgrantee under the Violence Against Women Act subchapter, what release is demanded, and whether a statute or court mandate is asserted. Do not decide that the record is released. |
| What the lawyer must review | The lawyer decides whether anything is released and what notice is given. 34 U.S.C. § 12291(b)(2) requires grantees and subgrantees under that subchapter to protect the confidentiality and privacy of persons receiving services. Subject to the statutory exceptions, they shall not disclose personally identifying information or individual information collected in connection with services requested, used, or denied, and they shall not disclose individual client information without the informed, written, reasonably time-limited consent of the person. Consent for a minor or a person under guardianship is not given by the abuser. If a release is compelled by statutory or court mandate, the grantee shall make reasonable attempts to notify the victims affected and shall take steps necessary to protect their privacy and safety. The same paragraph allows specified sharing of non-personally identifying aggregate data, of court-generated and law-enforcement information in secure registries for protection-order enforcement, and of law-enforcement and prosecution information necessary for those purposes. It does not allow personally identifying information to be demanded as a condition of services, or to be shared to meet a grant reporting requirement. A covered-housing provider has a separate duty under 34 U.S.C. § 12491(c)(4) to keep survivor information confidential, with disclosure only if the person consents in writing, the disclosure is required for an eviction proceeding under that subsection, or applicable law otherwise requires it. This is not a general evidence privilege for every counselling note in every court. |

## Checking plan

- What the AI does: List the program that holds the record, whether that program is a grantee or subgrantee under the Violence Against Women Act subchapter, what release is demanded, and whether a statute or court mandate is asserted. Do not decide that the record is released.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The lawyer decides the release. A summary of the record is not a disclosure authority.
- The duty is on VAWA grantees and subgrantees, and, for housing, on the covered-housing provider. It is not a ban on every agency holding a protection-order file.
