## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Family Violence & Protection Orders](https://ailawframework.com/practice/family-violence-and-protection-orders.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the order, the application, and the list of people who will receive documents, list every name, school, workplace and address that the opened publication rule would restrict, and every recipient who is outside the lawyer's office. Do not write a publication. Do not include the address in the protocol if the protocol itself will be emailed widely. |
| What the lawyer must review | The lawyer decides what may be published or sent, whether a court direction or order is required before a name is used, and how the file is labelled so staff do not put the address in a served document. |

## Checking plan

**Source-by-source verification**

Check each proposed recipient against the publication rule that was opened, and keep addresses out of the protocol.

- What the AI does: From the order, the application, and the list of people who will receive documents, list every name, school, workplace and address that the opened publication rule would restrict, and every recipient who is outside the lawyer's office. Do not write a publication. Do not include the address in the protocol if the protocol itself will be emailed widely.
- What the lawyer does: The lawyer decides what may be published or sent, whether a court direction or order is required before a name is used, and how the file is labelled so staff do not put the address in a served document.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Apply s 45 to a child in New South Wales without waiting for a direction. An adult needs the court's direction under s 45(2), unless another rule applies.
2. In Victoria, s 166 covers reports of the proceeding and about the order. A court order under s 169 is required before identifying particulars are published.
3. Do not copy a New South Wales termination notice or its evidence to a co-tenant.
4. Read the protocol before it is circulated and remove any address that would identify the protected person.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
