## Checking plan

**Source-by-source verification**

From 20 October 2026, if generative AI is used to create, write, edit or otherwise prepare a Fair Work Commission document, the person must tell the Commission how it was used, check that the information is accurate, relevant and supported by real evidence and legal authorities, and state in the document that those checks were done. A legal practitioner must include hyperlinks to any case law in a document prepared using generative AI. Personal or confidential case information must not be entered into a public generative AI tool. For a witness statement, the witness must also make sure it is based on their own knowledge, reflects their own words, and is true to the best of their knowledge.

- What the AI does: Turn the proofing note into a draft statement for the witness to accept or reject sentence by sentence.
- What the lawyer does: The witness confirms the statement is their own knowledge, their own words, and true. State the generative AI checks in the document.
- Basis: Checked against the linked public source on 10 October 2026.
