## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Elder Law & Powers of Attorney / Guardianship](https://ailawframework.com/practice/elder-law-and-powers-of-attorney-guardianship.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the medical reports and facts brief, draft the application and a chronology, noting the tribunal and Act still to confirm. The tool writes no part of the applicant’s, a family member’s or a carer’s evidence in the pack, however the tribunal titles it — affidavit, statutory declaration or written statement: no draft, no scaffold, no suggested paragraphs; it indexes the annexed medical and financial documents and lists the facts still needing a source. |
| What the lawyer must review | Verify every citation and tribunal decision on AustLII; do not use AI to verify AI citations (VCAT PNVCAT11) Follow NCAT PD7 (from 7 April 2025): authenticate AI-assisted submissions Get NCAT leave for AI-assisted expert reports; follow Federal Court GPN-AI (16 April 2026) on disclosure Confirm the right tribunal and Act; errors are fatal to urgent interim orders Check medical evidence meets the tribunal's threshold; Tas: check reforms from 1 September 2024 WA: apply the Guardianship and Administration Act 1990; no replacement Act yet Note the LRCWA Final Report (tabled 26 February 2026); confirm the deponent can verify each paragraph |

## Checking plan

**Lawyer review required**

The responsible lawyer reviews the work against the instructions, sources and intended use.

- What the AI does: Potential support includes organising research leads and preparing preliminary structure or wording. Confirm the tool’s capability and permitted scope.
- What the lawyer does: Set the scope, verify the evidence, resolve exceptions and approve the final output for its intended use.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Suggested checking approach based on the task guidance. Complete the assessment for the actual tool, information and jurisdiction.
- Why: The plan reflects the described work and review requirements. Policy colours are not used to determine permission or checking.

## Checks the lawyer makes

1. Open each relied-on authority independently. Confirm its existence, current status, proposition and any quotation or pinpoint reference.
2. Confirm each factual assertion with the witness and original record. Preserve the witness’s own knowledge and words, and check the court’s rules for this document.
3. Confirm that the actual tool, feature and processing terms permit use of this information, including access, retention, training and disclosure conditions.
4. Check the specialist’s assumptions, qualifications and limits. Obtain the relevant expert or specialist review before relying on a technical conclusion.
5. Confirm instructions and personal circumstances through appropriate direct engagement. Have the responsible lawyer assess safety, capacity or vulnerability concerns and escalation.
6. Preserve original files and relevant metadata. Document provenance and handling, and seek forensic review where authenticity needs to be resolved.
7. Verify the applicable jurisdiction and the version of each relevant law, rule or instrument in force at the material time.
8. Confirm the output against the client’s instructions and the complete relevant source material, including omissions or contradictions.
9. Resolve exceptions and record the responsible lawyer’s approval of the exact output and intended use.

## Notes

- Confirm the required checking with the responsible lawyer before work starts. The checking approach does not establish permission to use AI.

*Practice guidance for planning and review. Confirm current primary sources and the requirements of the actual matter. This is general information, not legal advice.*
