Also covers: Eldercare law, succession planning, advance planning, substitute decision-making, guardianship and administration, enduring power of attorney (EPOA), enduring guardianship (EG), advance care directive (ACD), advance personal plan (APP, NT), financial management orders, administration orders, restrictive practices substitute decision-making

Elder law spans the execution of advance planning instruments (enduring powers of attorney, enduring guardianship/representation, advance care directives, advance personal plans), tribunal proceedings for substitute decision-making orders, and protection from elder financial abuse. The core AI risk profile is severe: the work is form-critical and jurisdiction-fragmented (nine distinct legislative schemes across eight states/territories, many with prescribed forms invalidated by a single omission), the central professional duty — assessing a client's decision-making capacity and detecting undue influence — is non-delegable, deeply interpersonal and cannot be inferred from text, and the clients are by definition in a vulnerable life stage where a document error or missed red flag causes irreversible harm.

## Key facts

- Tasks: 31
- Green: 10, Yellow: 17, Red: 4
- Levels: Green is AI drafts and the lawyer checks; Yellow is lawyer and AI draft together; Red is the lawyer writes and AI may only check, clarify or collect data.

## Principles

- **Define the matter**: Confirm the client’s instructions, jurisdiction, intended output and the information available before dividing the work.
- **Verify the authorities**: Open each relied-on authority independently. Confirm its existence, current status, proposition and any quotation or pinpoint reference.
- **Reconcile the figures**: Trace every relied-on figure to its source, confirm dates and assumptions, and independently recalculate totals or derived amounts.

## Checklist

- Open each relied-on authority independently. Confirm its existence, current status, proposition and any quotation or pinpoint reference.
- Trace every relied-on figure to its source, confirm dates and assumptions, and independently recalculate totals or derived amounts.
- Check the current court or regulator requirements, prescribed form and attachments for the intended document and filing.
- Confirm instructions and personal circumstances through appropriate direct engagement. Have the responsible lawyer assess safety, capacity or vulnerability concerns and escalation.
- Verify the applicable jurisdiction and the version of each relevant law, rule or instrument in force at the material time.
- Resolve exceptions and record the responsible lawyer’s approval of the exact output and intended use.

## Restrictions

- Confirm firm, client and applicable court or professional restrictions before using any AI feature.

## Jurisdiction note

Apply this guidance to the actual matter and jurisdiction. Confirm current requirements before relying on an example.

## Basis

Practice guidance supports planning; the responsible lawyer confirms the scope, evidence and review requirements for the matter.

## Limits on AI assistance

Red lines — never in this area

## Limits on AI assistance

AI must never assess, conclude on, or document a client's decision-making capacity — this is a non-delegable professional judgment under ASCR rr 4.1.1 and 4.1.2 and the Law Council Best Practice Guide on Assessing Mental Capacity (June 2023). AI must never detect, conclude on, or substitute for the lawyer's personal assessment of undue influence or elder financial abuse — these are inherently observational, interpersonal and non-delegable. AI must never generate the prescribed statutory form for a power of attorney, enduring guardianship, advance care directive, advance personal plan (NT) or guardianship application — it may only draft content to be inserted by the lawyer into the current approved form; form versions change (SA ACD form March 2024; Vic Powers of Attorney Regulations 2025 from 10 August 2025) and use of a superseded or AI-paraphrased form causes invalidity. AI must never be used to verify AI-generated legal citations — VCAT Practice Note PNVCAT11 expressly prohibits this; all citations must be verified against Austlii or a primary jurisdiction database; non-compliance has resulted in practitioner licence restrictions (Dayal, Victorian Legal Services Board, 19 August 2025). AI must never conduct a remote-witnessing session, advise on the sufficiency of witnessing in real time, or certify that witnessing requirements have been met. AI must never generate a document that purports to revoke an existing power of attorney, guardianship appointment or advance personal plan — revocation has strict formal requirements and must be supervised entirely by the lawyer. Confidential client information (including health history, cognitive assessments, family relationships and asset details) must never be input into a consumer AI tool (free ChatGPT, Gemini, Copilot consumer tier) — only enterprise tools with Australian data residency, data isolation and a signed DPA compliant with APP 8 and APP 11 may be used. AI must never advise on the interaction between an existing guardianship order, a proposed EPA or ACD, and (from 1 July 2025 in Vic / 1 November 2025 Cth) the restrictive practices substitute decision-maker regime — the hierarchy of instruments varies by jurisdiction and a wrong answer may cause the client to execute an instrument that is immediately overridden or void. AI must never be used to advise that the NT equivalent of an enduring power of attorney is a 'Powers of Attorney Act' instrument — NT replaced enduring powers of attorney with Advance Personal Plans under the Advance Personal Planning Act on 17 March 2014; any pre-2014 enduring EPA remains valid but new appointments take a fundamentally different form.

## Jurisdiction-specific considerations

Australian traps

## Jurisdiction-specific considerations

Nine legislative schemes across eight jurisdictions, no uniform national framework: Powers of Attorney Act 2014 (Vic), Powers of Attorney Act 2003 (NSW), Powers of Attorney Act 1998 (Qld), Powers of Attorney and Agency Act 1984 (SA), Powers of Attorney Act 2014 (WA), Powers of Attorney Act 2000 (Tas), Powers of Attorney Act 2006 (ACT) [NOT 2003 — a common AI error], and the Advance Personal Planning Act (NT) [NOT the Powers of Attorney Act 1980 (NT) — enduring powers of attorney were replaced in NT on 17 March 2014 by Advance Personal Plans]. AI cannot reliably identify which Act and which current form applies without explicit direction; confirmed NT and ACT Act citations are two of the most frequent AI errors in this area. Prescribed forms with nil-tolerance execution: a single omitted statement in a witness certification block invalidates the instrument — confirmed in Singer v No Defendant [2026] NSWCA 38 (omission of the s 19(1)(c)(iv) Powers of Attorney Act 2003 (NSW) statement that the witness was not an attorney under the instrument). Although equitable rectification was allowed on the facts of Singer, it required two Supreme Court proceedings at the client's cost and cannot be assumed available; a defective instrument used at incapacity may be irremediable. AI drafting tools routinely paraphrase rather than reproduce statutory certification language. Victoria prescribed form change 10 August 2025: the Powers of Attorney Regulations 2025 (Vic) commenced on 10 August 2025 and replaced all previous Vic EPA prescribed forms. The LPLC now requires use of the Form 1 Schedule 1 format under the 2025 Regulations. Any AI tool trained before this date, and many post-training outputs, will generate the superseded form. Every Vic EPA file must have the form version confirmed against the current Vic legislation register before execution. SA ACD form changed 1 March 2024 (Advance Care Directives (Miscellaneous) Amendment Regulations 2024 (SA)) — witness class narrowed to legal practitioners, JPs and registered health practitioners. AI tools trained before this date will produce incorrect witnessing instructions for SA advance care directives. Tasmania guardianship reforms commenced 1 September 2024 under the Guardianship and Administration Act 1995 (Tas) — changed terminology ('functions' to 'personal matters', 'estate' to 'financial matters') and introduced supported decision-making principles. AI research tools may still use pre-reform terminology causing confusion about powers and roles. WA guardianship reform: LRCWA Final Report on the Guardianship and Administration Act 1990 (WA) was tabled 26 February 2026. As at June 2026, replacement legislation has not been introduced. WA matters continue under the 1990 Act and the State Administrative Tribunal (WASAT). AI tools may incorrectly state that WA has already enacted a new scheme. Aged Care Act 2024 (Cth) commenced 1 November 2025 — new rights-based framework, new substitute decision-maker consent requirements for restrictive practices, new reporting obligations under Aged Care Rules 2025. The Aged Care Act 1997 is superseded. AI trained before November 2025 will reference the wrong Act for mandatory reporting, consent obligations and enforcement powers. Aged Care Restrictive Practices Substitute Decision-maker Act 2024 (Vic) commenced 1 July 2025 — creates a four-tier statutory hierarchy for substitute decision-maker consent to restrictive practices in Victorian residential aged care facilities, operating independently of a resident's existing EPA or guardianship order. AI tools trained before this date are unaware of this framework. NT Advance Personal Planning Act: since 17 March 2014 the NT does not use enduring powers of attorney. The Advance Personal Plan covers financial, legal, lifestyle and healthcare decisions in a single instrument. AI tools frequently cite the Powers of Attorney Act 1980 (NT) as the governing Act, which is wrong for new appointments and could cause a practitioner to advise a client on a non-existent instrument. Vic Medical Treatment Planning and Decisions Act 2016: from March 2018, medical powers of attorney in Vic were replaced by 'medical treatment decision makers' and advance care directives under a distinct Act. AI tools regularly conflate these with the Powers of Attorney Act 2014 regime — the consequence is a client believing one instrument covers both financial and medical domains. Disability Royal Commission recommendations (Final Report 2023, progress monitoring ongoing): driving uneven and staggered state-by-state guardianship law reform including renaming roles and introducing 'support orders'. An AI research tool may state the law has changed in a jurisdiction where it has not yet commenced, or conversely fail to flag reforms that have commenced. Qld registration requirement: EPOAs affecting land must be registered with Queensland Titles Registry before the attorney can deal with land. A missed registration step means the instrument cannot be used for its primary purpose. AI checklists frequently omit this step. Remote witnessing: all jurisdictions introduced emergency remote witnessing rules; some have made them permanent with additional conditions (Vic s 5A Powers of Attorney Act 2014 requires a 'special witness' who is a legal practitioner or JP, same-day completion and compliant audiovisual link under the Powers of Attorney Regulations 2025). AI checklists for witnessing must be jurisdiction-and-mode-specific. VCAT Practice Note PNVCAT11 and NCAT Procedural Direction 7 (PD7, commenced 7 April 2025): both require disclosure of AI use in submissions and prohibit using AI to verify AI citations. Federal Court GPN-AI (16 April 2026) extends equivalent requirements to Federal Court proceedings including any elder care matters in federal jurisdiction. Practitioners who submit AI-generated submissions without verification face adverse costs orders and referral risk (see Dayal, Victorian Legal Services Board licence variation 19 August 2025). Limitation periods for challenging instruments: applications to set aside on the ground of lack of capacity or undue influence are governed by state legislation and equitable doctrines with no uniform period; tribunal applications for administration/guardianship orders are not formally time-limited but delay causes irreversible harm. AI must not advise on limitation without lawyer review. National Plan to End the Abuse and Mistreatment of Older People 2026–2036 (launched March 2026) signals a decade of intensifying regulatory and legislative focus on elder abuse — firms advising in this area should maintain current internal elder abuse referral protocols and expect continued amendment to reporting and consent frameworks.

## Risks to address

How it goes wrong

## Risks to address

AI generates witness certification language that paraphrases (rather than reproduces verbatim) the statutory form — instrument executed on that draft is void at the point of need (incapacity); although Singer v No Defendant [2026] NSWCA 38 shows rectification may be possible, it requires costly Supreme Court proceedings and cannot be relied upon. AI uses the superseded pre-10 August 2025 Victorian prescribed form for an enduring power of attorney — instrument executed after 10 August 2025 on the old form may be invalid; AI tools trained before August 2025 do not know the Powers of Attorney Regulations 2025 (Vic) exist. AI cites the Powers of Attorney Act 2003 for an ACT matter (confusing it with the NSW Act of the same year) or the Powers of Attorney Act 1980 (NT) for a new NT appointment — lawyer advises a client on the wrong instrument; NT client executes a document that does not exist under current NT law. AI research tool cites a guardianship or administration tribunal decision that does not exist or misstates the capacity standard — submitted to NCAT, QCAT or VCAT; lawyer faces referral to legal services board (cf Dayal, Victorian Legal Services Board, 19 August 2025). AI uses the superseded Aged Care Act 1997 framework to describe mandatory reporting or consent obligations — lawyer fails to comply with Aged Care Act 2024 obligations in force since 1 November 2025 or the Vic restrictive practices SDM regime in force since 1 July 2025. AI produces SA advance care directive instructions using the pre-March 2024 witness class (which included teachers and social workers) — directive executed with an invalid witness is void.

## Review checklist

The lawyer's review checklist

## Review checklist

Jurisdiction confirmed and current prescribed form version verified — check form date against the relevant state authority (not AI output) before any execution; specifically confirm Vic files use the Powers of Attorney Regulations 2025 (Vic) Schedule 1 Form 1 (from 10 August 2025) and SA advance care directive files use the post-March 2024 form. Every witness certification block checked word-for-word against the statutory form — confirm all mandatory statements are present and verbatim, attorney and disqualifying relationships are excluded as witnesses, and for Vic remote witnessing, the special witness and same-day requirements are met. NT and ACT Acts confirmed: ACT matters proceed under the Powers of Attorney Act 2006 (not 2003); NT new appointments are Advance Personal Plans under the Advance Personal Planning Act (not EPOAs under the 1980 Act). Capacity assessment conducted privately by the instructing lawyer — file note exists recording questions asked and the client's own words in response; assessment was done without any proposed attorney, family member or third party present; AI was not used as proxy for any part of this assessment. Undue influence check documented — private meeting held without facilitating third party; open non-leading questions used; identity and financial interest of any person who organised the appointment recorded. All legislative citations and tribunal decisions in any research output or submission independently verified against Austlii or the primary state legislation database — AI was not used to verify AI-generated citations; disclosure obligations under VCAT PNVCAT11, NCAT PD7 or Federal Court GPN-AI checked if matter is in those jurisdictions. Client-identifying information, health history, cognitive assessment data and asset details confirmed as not entered into any consumer AI tool; enterprise tool DPA, data isolation and Australian data residency confirmed under APP 8 and APP 11. Where the Aged Care Act 2024 (Cth) (from 1 November 2025), the Aged Care Restrictive Practices Substitute Decision-maker Act 2024 (Vic) (from 1 July 2025), or state elder abuse reporting obligations may apply, lawyer has personally assessed whether an obligation is triggered — AI has not made that determination. For any Tasmanian, South Australian or Victorian medical treatment matter, confirm post-reform terminology and framework applies — AI output must not rely on pre-September 2024 (Tas), pre-March 2024 (SA ACD), or pre-March 2018 (Vic medical treatment) descriptions of these schemes.

## Tasks (31)

| Task | Level | How AI is used | What the lawyer must review |
| --- | --- | --- | --- |
| Draft an enduring power of attorney (financial) from the instructions | Yellow | Draft on the current prescribed form from the instructions, with a checklist of decisions (start date, multiple attorneys, gifts, conflicts) still to confirm. | Use the current prescribed form Handle capacity and execution yourself Confirm who is appointed and whether a later instrument revokes this one |

| Draft an advance care directive from the instructions | Yellow | Turn the client's treatment and values instructions into a first draft on the current form, listing optional clauses and witnesses required. | Use the current form; this is not medical advice Confirm the client understands and has capacity |
| Prepare a capacity-assessment file note and document list for the interview | Red | From the intake, list topics to cover, documents to sight, and warning signs for the lawyer to test. Do not generate a capacity finding. | Assess capacity yourself, often with a medical report Never outsource the finding to a tool |
| Screen for undue influence and elder financial abuse on the file | Red | From permitted documents and notes, list red flags and transactions that need an explanation, for the lawyer. | Do the screening yourself; do not accuse from a generated list Keep reporting and safety duties with the lawyer |
| [Prepare a guardianship or administration tribunal application pack](https://ailawframework.com/practice/elder-law-and-powers-of-attorney-guardianship/prepare-a-guardianship-or-administration-tribunal-application-pack.md) | Yellow | Under the lawyer's direction, fill in the tribunal's application form and build a chronology of the capacity events and the current support and financial… | Confirm the tribunal and the Act that apply where the person lives, that every order sought is one the tribunal can make and is the least restrictive option,… |
| Draft a plain-language explanation of the signed instrument for the client | Yellow | Turn the signed enduring power, guardianship appointment or advance care directive into a one-page explanation of who decides what, when it starts, and how to… | Check the explanation against the instrument, which governs Remove anything that contradicts it or adds powers |
| Review existing enduring powers, guardianship orders and advance care directives | Yellow | Compare the instruments, identify which is current, list inconsistencies, expiry/revocation issues and registration gaps. | Decide which instrument is in force; it is a legal conclusion Confirm against the register where one exists |
| [Map substitute decision-making for restrictive practices in aged or long-term care](https://ailawframework.com/practice/elder-law-and-powers-of-attorney-guardianship/map-substitute-decision-making-for-restrictive-practices-in-aged-or-long.md) | Yellow | From the care setting and existing appointments, list who appears to hold consent authority for restrictive practices and which instruments still need to be… | Check whether restrictive-practice consent is a separate regime from the general appointment Apply the current provider and substitute-decision rules |
| Prepare an elder-abuse referral and reporting checklist from the file | Yellow | From facts the lawyer has recorded, draft a referral letter and a checklist of mandatory or discretionary reporting paths in the client's jurisdiction. | Decide whether to report; it is a legal and safety judgment Do not send a generated report Protect location and contact details |
