## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Education Law](https://ailawframework.com/practice/education-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the complaint and the institution's records, index the allegations, the dates, the people named, and the policies and adjustment records that relate to each allegation. Note the date of the last act described, and whether an institutional grievance was finished and on what date. Do not write the response, an apology, or any proposed resolution. |
| What the lawyer must review | You write the response that is sent. OCR's how-to-file page, last reviewed 26 August 2025, says anyone may file, including for another person where any necessary written consent is obtained, and a parent filing for a student over 18 must secure that consent. A complaint must ordinarily be filed within 180 days of the last act. A waiver requires good cause. An institutional grievance is optional. If one is used, the OCR complaint must be filed within 60 days after that process ends. OCR enforces Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, and the Boy Scouts of America Equal Access Act. Coverage includes state education agencies, elementary and secondary systems, colleges and universities, vocational and proprietary schools, vocational rehabilitation agencies, libraries, and museums that receive federal financial assistance from the Department. Title II covers disability discrimination by public entities whether or not they receive that assistance. The covered aids and services include discipline. A recipient may not retaliate against a person who has complained, testified, assisted, or participated in an OCR matter. The Section 504 FAPE questions say that, except in extraordinary circumstances, OCR does not review the result of an individual placement where the district complied with the procedural requirements, and that OCR generally will not evaluate the content of a Section 504 plan or an IEP. |

## Checking plan

- What the AI does: From the complaint and the institution's records, index the allegations, the dates, the people named, and the policies and adjustment records that relate to each allegation. Note the date of the last act described, and whether an institutional grievance was finished and on what date. Do not write the response, an apology, or any proposed resolution.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The 60-day OCR period applies where an institutional grievance was used.
- The how-to-file page does not set the institution's own grievance timetable.
- Discipline is among the aids and services that page says must be nondiscriminatory. A State's suspension statute is a separate instrument.
