| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the enrolment records and the provider's note of what stopped, list each affected confirmation of enrolment, the agreed start day or the day the course stopped, whether the student had commenced, and the dates by which a notice to the ESOS agency and the TPS Director, a written notice to the student, a placement or refund, and an outcome notice would fall if the default day is the date the provider has recorded. Do not decide that a default has occurred, and do not write the notices. |
| What the lawyer must review | The lawyer decides whether section 46A of the ESOS Act is met, whether a default exception notice under section 46A(4) is available for a change of legal entity, and whether the provider will arrange an alternative course the student accepts in writing or refund unspent tuition. The lawyer writes the notices. Notice to the ESOS agency and the TPS Director is due within 3 business days, the student notice must be in writing and in plain English, the placement or refund is due within 14 days after the default day, and the outcome notice is due within 7 days after the end of that provider obligation period. Notices for each affected confirmation of enrolment are lodged in PRISMS. |

## Checking plan

**Source-by-source verification**

Trace each student and date to the enrolment record, and leave the default decision and the notices to the lawyer.

- What the AI does: From the enrolment records and the provider's note of what stopped, list each affected confirmation of enrolment, the agreed start day or the day the course stopped, whether the student had commenced, and the dates by which a notice to the ESOS agency and the TPS Director, a written notice to the student, a placement or refund, and an outcome notice would fall if the default day is the date the provider has recorded. Do not decide that a default has occurred, and do not write the notices.

- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Check each confirmation of enrolment and start day against the provider's enrolment record.
2. Count 3 business days, 14 days and 7 days from the default day the lawyer has accepted, not from the day the tool was run.
3. Confirm a student who had not commenced is marked for a full refund of tuition if the provider refunds rather than places.
4. Confirm prepaid fees of a non-exempt provider were held in the designated account until commencement.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
