| How AI is used | Identify the record, whether the student is an eligible student, and what the order commands. Do not release anything. |
| What the lawyer must review | 20 U.S.C. § 1232g conditions federal funds on parental access to education records and, in § 1232g(b), on not releasing education records or personally identifiable information without written consent, subject to the statutory exceptions. 34 C.F.R. § 99.31(a)(8) allows disclosure without that consent to parents of a dependent student as defined in section 152 of the Internal Revenue Code. Section 99.31(a)(9) allows disclosure to comply with a judicial order or lawfully issued subpoena, but only if the agency makes a reasonable effort to notify the parent or eligible student in advance so they may seek protective action, unless one of the stated exceptions applies. Section 99.31(a)(12) allows disclosure to the parent of a student who is not an eligible student, or to the student. The lawyer reads the order against those paragraphs before any record is released. Rule 1.6 applies to the file in any tool. |

## Checking plan

- What the AI does: Identify the record, whether the student is an eligible student, and what the order commands. Do not release anything.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- A parenting order is not automatically a FERPA consent. If it is used as a judicial order, the advance-notice step in § 99.31(a)(9) still has to be checked.
- Directory information is a defined list in § 1232g and may be released only after the required public notice and opt-out period. It is not a back door for grades or discipline records.
