## Key facts

- Tasks: 15
- Green: 3, Yellow: 9, Red: 3
- Levels: Green is AI drafts and the lawyer checks; Yellow is lawyer and AI draft together; Red is the lawyer writes and AI may only check, clarify or collect data.

## Basis

Planning guidance checked on 18 October 2026. Confirm the current instrument before reliance.

## How this work usually runs

A school matter usually starts with a phone call from a parent: a suspension notice, a proposal to expel or exclude, a refused enrolment, or a dispute about how a child's disability or behaviour is being managed. The lawyer gets the notice, the school's behaviour and incident records, the student's support or behaviour plans and any disability documentation, and identifies which instrument governs: the State department's procedures for a government school, such as the NSW Suspension and expulsion procedures, Victoria's Ministerial Order 1125 and the mandatory expulsion guidelines, or chapter 12 of the Education (General Provisions) Act 2006 (Qld), or the enrolment contract and policies of a non-government school. The work is procedural fairness first: was the student told the allegations, given a chance to respond, decided by an impartial person, and told of the right of appeal or review, and were the additional steps for priority cohorts taken. The lawyer helps the family prepare a response before the decision and an appeal or review after it, within the time the instrument allows, and checks the decision against the Disability Standards for Education 2005 where the student has disability. For schools the same instruments run the other way, with the lawyer advising the principal before a decision is made. In higher education the usual matters are academic misconduct, including allegations of unauthorised gen AI use, exclusion for unsatisfactory progress, and complaints; the student works through the provider's rules and internal appeal and may then complain to the National Student Ombudsman. Provider-side work covers TEQSA registration and the Higher Education Standards Framework, ASQA audits against the 2025 Standards for RTOs, and child safe compliance: the 11 Victorian Child Safe Standards, or the NSW Child Safe Standards in Part 9A of the Children's Guardian Act 2019, which the Children's Guardian can monitor, investigate and enforce with compliance notices.

## Why education law is its own area

Families, students, schools, universities and training providers bring the same kinds of matters again and again: a suspension or expulsion, a refused enrolment, an academic misconduct finding, a complaint the provider would not resolve, a regulator's audit. Each runs under its own instrument, such as a State Education Act, Victoria's Ministerial Order 1125, the Higher Education Standards Framework or the 2025 Standards for RTOs, and its own reviewer. Generative AI is often the subject of the dispute itself, through academic integrity allegations, as well as a tool in the lawyer's hands.

## Children's records stay out of tools by default

Behaviour records, incident reports, health and disability information, child safety allegations and the names of other students are about children who cannot consent for themselves. Decide what may go into a tool, under what terms and with whose agreement before uploading anything, and remove other students' details from anything that does not need them.

## Take the procedure from the instrument for that school

Government school procedures differ by State and differ again for non-government schools, which act under their enrolment contracts and their own policies. New South Wales procedures require the right to be heard, an impartial decision and a right of appeal. Victoria's Ministerial Order 1125 adds requirements for students in out-of-home care, Koorie students and students with substantial or extensive adjustments. In Queensland a suspension of 10 to 20 days or an exclusion can be reviewed by the chief executive. A template built for one system will omit steps another requires.

## An AI misconduct allegation is answered in the student's own words

TEQSA has published resources on gen AI, academic integrity and assessment reform, and providers' rules on declaring AI use differ. When a student is accused of using AI improperly, the account of how they produced the work is their own evidence. A tool may index drafts, version histories and the provider's policy; it must not write the student's explanation.

## Know which regulator or reviewer can act

The National Student Ombudsman considers complaints about TEQSA-registered higher education providers once the provider has dealt with them or where the student cannot complain directly, but not complaints about academic judgement such as a grade. ASQA regulates registered training organisations against the 2025 Standards, in full effect from 1 July 2025. The Children's Guardian in New South Wales has enforced the Child Safe Standards since 1 February 2023. Send each matter to the body that can actually decide it.
