## Key facts

| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | For each publication, record the name, the date, the URL or place if printed, and any number of copies the capture prints. Write no sentence of the statement that will be filed. |
| What the lawyer must review | You write the statement, and you characterise the extent. Civil Code § 45 defines libel. Section 48a(d)(1) defines general damages as damages for loss of reputation, shame, mortification, and hurt feelings. Section 48a(d)(2) defines special damages as all damages the plaintiff alleges and proves that he or she has suffered in respect to property, business, trade, profession, or occupation, including the amounts of money expended as a result of the alleged libel, and no other. A copy count is not special damages until you characterise it. Section 48a(a) limits recovery for libel in a daily or weekly news publication, or slander by radio broadcast, to special damages unless a correction is demanded and is not published or broadcast as the section provides. Section 48a(d)(5) defines a daily or weekly news publication as a publication, in print or electronic form, that contains news on matters of public concern and that publishes at least once a week. Section 48a is not a retraction statute for every online post. |

## Checking plan

- What the AI does: For each publication, record the name, the date, the URL or place if printed, and any number of copies the capture prints. Write no sentence of the statement that will be filed.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Section 48a is California, and it is limited to a daily or weekly news publication or to slander by radio broadcast. You decide whether this publication is inside that limit.
- The table records what the capture prints. It is not the statement that will be filed.
