| What the lawyer must review | The lawyer decides a petition may be presented, chooses the court, prepares the petition in that court's form, and proves service and the act of bankruptcy. ## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the lawyer's marked documents, list the NPII search result, the judgment, the bankruptcy notice issue date, the service date and the date of non-compliance. Do not draft the petition.
- What the lawyer does: The lawyer decides a petition may be presented, chooses the court, prepares the petition in that court's form, and proves service and the act of bankruptcy. The Federal Court information sheet says a petition in that Court is Form B6 and seeks a sequestration order under section 43(2).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm the act of bankruptcy relied on is non-compliance with the bankruptcy notice and that it is still within the six months AFSA describes.
2. Confirm the NPII search is current and that the lawyer, not the tool, has read it.
3. Use Form B6 only for a petition in the Federal Court, as that Court's information sheet states. Do not assume the same form number in the other court.
4. Do not draft the petition. Every sentence that is filed is the lawyer's.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
