| How AI is used | Record whether the debtor or mortgagor is marked as in default, whether a default notice under section 88 has been given to the debtor and any guarantor or to the mortgagor, and whether that notice includes a statement of how the liabilities would be affected and the amount required to pay out the contract as accelerated. Record whether the default was remedied in the notice period. Record any exception the lawyer marks. Do not say the clause can operate. |
| What the lawyer must review | The lawyer decides whether section 93 is met, whether the default can be remedied, and whether any exception applies. The lawyer also checks section 88 before enforcement of the contract itself. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: Record whether the debtor or mortgagor is marked as in default, whether a default notice under section 88 has been given to the debtor and any guarantor or to the mortgagor, and whether that notice includes a statement of how the liabilities would be affected and the amount required to pay out the contract as accelerated. Record whether the default was remedied in the notice period. Record any exception the lawyer marks. Do not say the clause can operate.
- What the lawyer does: The lawyer decides whether section 93 is met, whether the default can be remedied, and whether any exception applies. The lawyer also checks section 88 before enforcement of the contract itself.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. An acceleration clause operates only if the debtor or mortgagor is in default and the three further requirements are met: a section 88 default notice to the debtor and any guarantor, or to the mortgagor; an additional statement in that notice of how the liabilities would be affected and of the accelerated payout amount; and the default not remedied in the notice period, unless the credit provider reasonably believes it cannot be remedied.
2. This is additional to the decision whether enforcement of the contract can start. It does not replace that decision.
3. A notice and a wait are not required if the credit provider reasonably believes it was induced by fraud, has made reasonable attempts to locate the debtor or mortgagor without success, is authorised by the court not to give the notice, or reasonably believes mortgaged goods have been or will be removed or disposed of without permission or that urgent action is necessary to protect them. The tool does not decide those beliefs.
4. Section 93 is in addition to any other law on enforcement of real property mortgages. Those laws were not opened.
5. Do not quote a penalty. Section 93A was read only in part and is not applied here.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
