This page is for lawyers recovering a civil debt or advising on enforcement. It is not a debt-collection script for clients and it does not say that a particular claim is in time.

Software is useful when the file is a pile of invoices and the lawyer needs a schedule. It is a poor place to decide limitation, service or which court has jurisdiction.

## Key facts

- Tasks: 14
- Green: 3, Yellow: 7, Red: 4
- Levels: Green is AI drafts and the lawyer checks; Yellow is lawyer and AI draft together; Red is the lawyer writes and AI may only check, clarify or collect data.

## Summary

Debt recovery is high-volume work where a wrong debtor, stale claim or wrong court is costly to undo. Software lines up the contract, ledger and a draft; the lawyer decides if the debt is due, in time and in the right forum.

## Principles

- **Name the debt before the letter**: Separate the contract, the invoices, the payments and any dispute. A draft that adds interest, costs or a cause of action the instructions do not support is not ready to send.
- **Find the forum before you plead**: State and territory courts, tribunals and the Federal Court do not share one monetary limit or one set of forms. Confirm the current limit and the prescribed form for the court you intend to use.
- **Calculate time from the statute, not from habit**: Open the limitation statute for that forum. Check the cause of action, the date it accrues, and any extension, acknowledgement or suspension. Do not assume every contract claim is six years.

## Checklist

- Match the debtor’s name to the contract, the invoice and any guarantee.
- Reconcile the amount to the ledger, including payments, credits and the interest clause you actually rely on.
- Identify the court or tribunal, its current monetary jurisdiction and the prescribed originating process.
- Calculate the limitation period from the statute of that forum and record the start date and any extension.
- Read the final letter or pleading against the instructions before it is sent or filed.

## Restrictions

- Do not file, send or rely on generated text until the responsible lawyer has checked it against the instructions and the current source.
- Do not put suppressed, privileged, subpoenaed or safety-sensitive information into a public AI tool.

## Jurisdiction note

Enforcement after judgment is local. A New South Wales garnishee process is not a Victorian or Queensland process. Open the jurisdiction page for the court that entered, or will enter, the judgment.

## Basis

Planning guidance checked against the linked public sources on 22 September 2026. Confirm the current instrument before reliance.

## What this work is

Start from the document that creates the debt, the account that shows what is unpaid, and the court that can hear it. A letter of demand, a statement of claim and an enforcement choice are three different documents. Each one needs its own check.

## Review checklist

- Match the debtor’s name to the contract, the invoice and any guarantee.
- Reconcile the amount to the ledger, including payments, credits and the interest clause you actually rely on.
- Identify the court or tribunal, its current monetary jurisdiction and the prescribed originating process.
- Calculate the limitation period from the statute of that forum and record the start date and any extension.
- Read the final letter or pleading against the instructions before it is sent or filed.

## Jurisdiction-specific considerations

- A six-year habit is not a limitation opinion. Deeds, statutory claims, judgments and acknowledgements can run on different clocks.
- Interest and costs follow the contract or the court scale. Do not import a rate from another matter.
- Service, default judgment and enforcement are procedural. Use the rules of the court you are in, and the court AI protocol if you are filing there.

## Tasks (14)

| Task | Level | How AI is used | What the lawyer must review |
| --- | --- | --- | --- |
| [Draft a letter of demand from the contract and the ledger](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement/draft-a-letter-of-demand-from-the-contract-and-the-ledger.md) | Yellow | Draft a letter of demand from the contract, the invoices and a lawyer-approved chronology of the unpaid amount. | Read the draft against the contract and the ledger Remove interest, costs or allegations the instructions and contract do not support |
| [Decide whether the claim is in time and in the right court](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement/decide-whether-the-claim-is-in-time-and-in-the-right-court.md) | Red | Organise the candidate cause of action, the forum and the possible start dates into a table for the lawyer to decide whether the claim is in time. | Decide whether proceedings are in time and which court can hear them Treat the generated table only as a list of dates to check |
| [Draft particulars of a liquidated claim](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement/draft-particulars-of-a-liquidated-claim.md) | Yellow | Draft particulars of a liquidated claim from the contract, the ledger and the lawyer’s chosen court form. | Read each particular against the source document Remove uninstructed facts and figures that do not reconcile |
| [Compare enforcement options after judgment](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement/compare-enforcement-options-after-judgment.md) | Yellow | Extract the judgment amount, the date and the known assets into a comparison of the enforcement processes the lawyer has named. | Check the judgment details against the sealed order Do not treat a list of options as advice to issue a particular warrant or garnishee |
| Draft default or summary-judgment papers from the liquidated file | Yellow | Under the lawyer's direction, work up the request for default judgment or the notice of motion for summary judgment, the interest-to-judgment and scale-costs… | Check the judgment sum, the interest period and rate and the costs claimed against the ledger, the contract and the current scale, and confirm the default or… |
| Draft an instalment or settlement agreement from the approved terms | Yellow | Produce a first-draft instalment deed or consent judgment from the lawyer's approved payment plan, default clause and release. | Check the arrears figure against the ledger Do not accept a release that is too wide: it is worse than no deal |
| Draft a statutory or insolvency demand from the judgment or the debt | Red | The lawyer writes the demand; the tool extracts from the sealed judgment, the invoices and the ledger the amount outstanding at the date of the demand and the… | The lawyer confirms the demand is their own words, that the amount demanded is due and payable and reconciles to the cent with the judgment or the ledger at… |
| Draft an examination, garnishee or third-party debt application from the asset notes | Yellow | From the judgment and the known-asset notes, produce first-draft examination or garnishee papers using the process the lawyer has chosen. | Check the sealed judgment details Do not treat a generated asset list as a search |
| Check the claim pack against the current form, fee and registry rules before filing | Green | Compare the completed originating document, particulars, party details and verification against the current form version, filing checklist and fee scale for… | Confirm the court and stream are right for the amount claimed and the relief sought, check the party names and entity type against the company and land… |
| Reconcile the debt, interest and recoverable costs to the judgment date | Red | Extract the transaction entries from the ledger and the statements, recalculate interest for each period against the basis, rate and rest days the lawyer has… | Select the interest basis and verify the rate against the current instrument for the period, decide which credits and costs are recoverable, and settle the… |
| Assemble the service evidence before asking for default judgment | Red | Index the service attempts, addresses, dates, post and courier records and searcher notes, compare each against what the rule requires for this party type,… | Decide whether service is good on each defendant, confirm the entity type and the last known address against current searches, and have the affidavit sworn… |
| Build the debtor's means and asset picture before choosing an enforcement step | Yellow | Organise the searches the lawyer has ordered — company and business-name extracts, land titles, personal property security, vehicle and bankruptcy searches,… | Decide which entries actually belong to this debtor before any step issues, confirm the debtor's identity and entity type against the judgment as entered, and… |
| Work out the protected earnings and exempt property before an income or property enforcement step | Green | Populate the firm's protected-amount worksheet from the debtor's pay or account data and the prescribed figure the template's rate source supplies, show the… | Verify the prescribed figure against the current instrument for that state and pay period, confirm which payments and which items of property are exempt, and… |
| Register an interstate judgment for enforcement where the debtor or the asset is | Green | Assemble the registration pack from the sealed judgment and the file: complete the receiving court's registration form and the notice to the judgment debtor… | Confirm the judgment is a registrable judgment of an Australian court rather than a foreign judgment under a different regime, that parties and amounts match… |

#### Small claims

The Disputes Tribunal, listed in the Courts of New Zealand GenAI guidelines.

#### State law

State law governs this work. Check the statutes, court rules and conduct rules of the state where the matter is. Do not import an Australian statute, form or court AI practice note.

#### Enforcement

Collections, garnishment and judgment enforcement are state procedure. The Fair Debt Collection Practices Act overlays many consumer debts.
