## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Criminal Law](https://ailawframework.com/practice/criminal-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | For each factual sentence in the letter, record whether the file contains that fact. Flag a sentence with no source in the file. Do not say the letter was produced by a tool and do not rewrite it. |
| What the lawyer must review | You decide whether the letter is handed up. Model Rule 3.3 is the duty of candor. Formal Opinion 512 warns against relying on text you have not checked. Section 3553(a)(1) is the factor for the history and characteristics of the defendant. The letter is someone else's statement. You do not adopt a sentence the file does not support. No method of detecting generated text was opened, so the check does not label a letter as generated. |

## Checking plan

- What the AI does: For each factual sentence in the letter, record whether the file contains that fact. Flag a sentence with no source in the file. Do not say the letter was produced by a tool and do not rewrite it.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not write a replacement sentence. The writer does that.
- A sentence about punishment is not confirmed by § 3553. The court applies that statute.
