## Key facts

| Fact | Value |

| Practice area | [Criminal Law](https://ailawframework.com/practice/criminal-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the clinical material the lawyer selects, list facts that touch the ability to understand the nature and consequences of the proceedings, and the ability to assist properly in the defense. Do not decide competency and do not write a motion. |
| What the lawyer must review | You decide competency and you write anything filed. Section 4241(a) says the defendant or the government attorney may move for a hearing, after prosecution has commenced and before sentencing, or during probation or supervised release before the sentence is complete. The court shall grant the motion, or order a hearing on its own motion, if there is reasonable cause to believe the defendant may presently be suffering from a mental disease or defect rendering him mentally incompetent to the extent that he is unable to understand the nature and consequences of the proceedings against him or to assist properly in his defense. That is two abilities. Do not add limbs from a state test. Section 4241(b) and (c) send the examination and the hearing to section 4247, which was not opened. Section 4241(d) is the court's commitment after a finding by a preponderance of the evidence, for a reasonable period not to exceed four months, and a further period on the terms stated there. Sections 4246 and 4248 were not opened. Section 4241(f) says a finding of competence shall not prejudice an insanity defense and shall not be admissible as evidence in a trial for the offense charged. The tool does not write the motion. Model Rule 3.3 applies to it. Formal Opinion 512 requires you to verify the clinical note. |

## Checking plan

- What the AI does: From the clinical material the lawyer selects, list facts that touch the ability to understand the nature and consequences of the proceedings, and the ability to assist properly in the defense. Do not decide competency and do not write a motion.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not treat a competency finding as evidence at the trial. Section 4241(f) says it is not.
- The four-month period is the court's, after a finding. The tool does not start that clock.
