## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Criminal Law](https://ailawframework.com/practice/criminal-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | For each element the lawyer writes, list the exhibit and the page that the lawyer says relates to it, or mark the element as having no exhibit in the file. Do not say the evidence proves the charge. |
| What the lawyer must review | You write the conclusion. Rule 16(a), upon the defendant's request, requires disclosure of specified statements, the prior record, and documents and objects in the government's possession, custody, or control that are material to preparing the defense, that the government intends to use in its case-in-chief, or that were obtained from or belong to the defendant. Brady v. Maryland holds that suppression by the prosecution, upon request, of evidence favorable to an accused violates due process where the evidence is material to guilt or to punishment, regardless of good or bad faith. Later cases that remove the request requirement were not opened. You decide what is exculpatory and what is missing. Model Rule 3.3 applies before a conclusion is handed up. |

## Checking plan

- What the AI does: For each element the lawyer writes, list the exhibit and the page that the lawyer says relates to it, or mark the element as having no exhibit in the file. Do not say the evidence proves the charge.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The Rule 16 list and the constitutional list are not the same. Keep both.
- Do not put the exhibits or the client's account into a public tool.
