## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Criminal Law](https://ailawframework.com/practice/criminal-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | List any draft in the file that is a proof of facts for a court or a letter to be signed by a third person. Record that those drafts are for the lawyer, not for the tool to finish. Do not finish them. |
| What the lawyer must review | You write anything that is handed up or signed. Model Rule 3.3 is the duty of candor toward the tribunal. Formal Opinion 512 warns against relying on generated text you have not checked. A letter signed by a third person is that person's statement. A proof of facts for a court is yours. This check does not produce either. Comment 8 to Rule 1.1 requires you to understand the tool well enough not to let it supply those documents. |

## Checking plan

- What the AI does: List any draft in the file that is a proof of facts for a court or a letter to be signed by a third person. Record that those drafts are for the lawyer, not for the tool to finish. Do not finish them.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not outline the facts either document would contain.
- No court's practice note on generated text was opened. Open the note of the court you are in.
