## Checking plan

**Verify against sources**

Section 56 lets a coroner give leave to appear as an interested party if satisfied the person has a sufficient interest. The lawyer decides that interest.

- What the AI does: List the facts of the client's connection that the lawyer has noted, against section 56 and the scope of the inquest. Do not draft the application and do not say that leave will be granted.
- What the lawyer does: The lawyer decides the interest, checks conflicts, and settles the application.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 56 is leave, not a right of appearance. The coroner must be satisfied of a sufficient interest.
2. Tie each asserted interest to a fact in the brief or the lawyer's instructions. Do not invent a family relationship.
3. Check the firm does not also act for an institution whose interest conflicts.
4. A request that an inquest be held is section 52(5), not this leave application. Keep the two steps separate.

## Notes

- No Coroners Court of Victoria generative artificial intelligence practice note was opened. Do not apply Supreme Court Practice Note SC GEN 25 as if it bound the Coroners Court.
- The application the coroner receives is settled by the lawyer.

## Practical guide

Jurisdiction: Coroners Court of Victoria

**Deliverable**: A fact list of the connection the lawyer has noted, for the lawyer to use when writing the leave application.

**Inputs**

- Lawyer's note of the client's connection
- Scope of the inquest
- Conflict check

**Example**: Illustrative example: The client is a family member who wants to test the care given in hospital. The list sets out that connection and the issues the lawyer has listed. It does not say leave has been granted, and it is not the application.

**Stop and escalate when**

- The sufficient interest is not identified by the lawyer.
- The firm has an unresolved conflict.
