| How AI is used | List the last date of labor or supply printed in the file, the amount claimed, the name of the party to whom the labor or material was supplied, and whether the claimant's contract is with the bonded contractor or with a subcontractor. Write no sentence of the notice. |
| What the lawyer must review | 40 U.S.C. § 3133(b)(1) lets a person who furnished labor or material on a bonded federal contract, and who has not been paid in full within 90 days after the last of that labor or material, sue on the payment bond. A person who contracts with a subcontractor, and not with the contractor who furnished the bond, must first give that contractor written notice within 90 days from the last of the labor or material. The notice must state the amount with substantial accuracy and the name of the party to whom the material was supplied or for whom the labor was done. It is served by a means that provides written, third-party verification of delivery, or as the United States marshal may serve summons. The action is in the name of the United States for the use of the claimant, in the district where the contract was to be performed, and no later than one year after the claimant's last labor or material. The Government is not liable for the costs of the action. You decide which path applies and you write any notice. |

## Checking plan

- What the AI does: List the last date of labor or supply printed in the file, the amount claimed, the name of the party to whom the labor or material was supplied, and whether the claimant's contract is with the bonded contractor or with a subcontractor. Write no sentence of the notice.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The 90-day written notice is for a claimant who deals with a subcontractor and has no contract with the bonded contractor. It is not required of every claimant.
- The one-year suit limit runs from the claimant's own last labor or material.
