| What the lawyer must review | There is no federal document, in the sections opened here, called a principal contractor's work health and safety management plan. 29 C.F.R. § 1926.20(b)(1) requires the employer to initiate and maintain such programs as may be necessary to comply with part 1926. Those programs shall provide for frequent and regular inspections of the job sites, materials, and equipment by competent persons designated by the employers. Machinery, tools, material, or equipment not in compliance with an applicable requirement of the part shall be tagged or locked out so the controls are inoperable, or physically removed. The employer shall permit only employees qualified by training or experience to operate equipment and machinery. Section 1926.20(a)(1) applies as a condition of contracts entered into under legislation subject to Reorganization Plan Number 14 of 1950, as defined in § 1926.12. Section 1926.21(b)(2) separately requires the employer to instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment. You decide whether this file's program meets § 1926.20(b) for this employer. The tool lists what the file shows. |
