## Checking plan

**Lawyer-led judgement**

Section 21 sets a different lodgement time for a short schedule, an unpaid scheduled amount, and a case with no schedule. The response time and the section 24 determination time are each a set of alternatives, not one period running from lodgement.

- What the AI does: Extract the date the payment schedule was received, the due date for payment, and the date of any notice of intention to apply into a list of adjudication triggers.
- What the lawyer does: Choose the section 21 path, calculate the notice, lodgement, response and determination dates from the Act, and record where the CBOS adjudication page does not state the same time.
- Who reviews: Lawyer competent in the matter and the forum
- Basis: Security of payment research on 22 September 2026. Confirm the instrument is still the in-force version.
- Why: The traffic light follows the consequence of missing a statutory payment or adjudication time.
- Restriction: The lawyer leads this decision. Assistance stays inside the preparation described for the task.

## Checks the lawyer makes

1. Open sections 21, 23, 24 and 28 of the in-force Act and the CBOS adjudication process page. Keep a time that the page states and the Act does not off the date list.
2. Where the scheduled amount is less, apply within 10 business days after the schedule is received. Where it is not paid in full, apply within 20 business days after the due date. Where there is no schedule, give notice within 20 business days after the due date, allow 5 business days for a schedule, and apply within 10 business days after that period ends.
3. Where section 23(1) allows a response, set it at the later of 10 business days after the respondent receives the application and 5 business days after notice of acceptance. Keep withholding reasons to those already in the payment schedule.
4. Choose the section 24 alternative that fits the facts, or any further period the parties agree. If no acceptance notice arrives within 4 business days after the application is made, a new application under section 28 may be made within 5 business days after the right to withdraw arises.

## Practical guide

Jurisdiction: Tasmania

**Deliverable**: A dated adjudication path naming the section 21 limb, the lodgement date, the response date under section 23(2), and the section 24 alternative that fixes the determination.

**Inputs**

- The payment claim, any payment schedule, and the due date
- Any notice under section 21(4) and the date it was given
- The in-force Tasmanian Act, sections 21, 23, 24 and 28
- The CBOS adjudication process page and the CBOS page on responding to a claim

**Example**: A claimant who receives a payment schedule for less than the claim on a Tuesday must apply within 10 business days after receiving it. The respondent who provided that schedule in time may then respond by the later of 10 business days after receiving the application and 5 business days after notice that the adjudicator has accepted the application.

**Stop and escalate when**

- The determination has been dated 10 business days after the application was lodged. Section 24 does not use lodgement as the start of that count.
- The response has been limited to 5 business days after appointment. Section 23(2) also allows 10 business days after the respondent receives the application, and the later period applies.
- A same-day deadline has been imposed for serving the application on the respondent. Section 21(7) requires a copy to be served and states no number of days.
- The no-schedule application is being lodged as soon as the 5 business days for a late schedule end. Section 21(4)(c) adds 10 business days after that period.
