## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Construction & Infrastructure](https://ailawframework.com/practice/construction-and-infrastructure.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | List each notice, claim and suit period in the subcontract, with the clause number and the event that starts the period. Leave statutory periods for the lawyer to add. |
| What the lawyer must review | Contractual notice periods and statutory suit periods are different clocks. For a Miller Act payment bond, a person who has not been paid in full within 90 days after the last labor or material may sue on the bond, a claimant with no direct relationship with the contractor must give written notice within 90 days of the last labor or material, and the action must be brought no later than one year after that last labor or material (40 U.S.C. § 3133). A waiver of the right to sue on the bond is void unless it meets § 3133(c). The lawyer adds the project state’s lien deadlines from the statute, not from the subcontract. Rule 1.1 and Formal Opinion 512 require that check. |

## Checking plan

- What the AI does: List each notice, claim and suit period in the subcontract, with the clause number and the event that starts the period. Leave statutory periods for the lawyer to add.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The 90-day Miller Act notice is for a person whose contract is with a subcontractor, not with the bonded contractor. Read § 3133(b)(2) before applying it.
- Do not use an Australian security-of-payment adjudication window.
