## Key facts

| Practice area | [Competition & Consumer Law (ACCC / ACL)](https://ailawframework.com/practice/competition-and-consumer-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the deal documents the lawyer selects, build a working table mapped to the questions on the ACCC notification-waiver application form: the parties, the acquisition, overlap, vertical or conglomerate links, and the four factors the ACCC must consider. Do not write the application, the declaration, or a conclusion that a waiver should be granted. |
| What the lawyer must review | The lawyer decides whether a waiver is suitable, writes the application, signs the declaration and lodges it with the fee. The ACCC says a waiver is for a straightforward acquisition that does not raise a material risk and can be assessed on the application without further investigation. It is not a first step before notification. The ACCC must consider the object of the Competition and Consumer Act 2010, the interests of consumers, the likelihood the thresholds apply, and the likelihood of a substantial lessening of competition. If no decision is made within 25 business days, the waiver must not be granted. The fee stated on the ACCC page is $8,300, set in the determination the page cites. Section 50 still applies after a waiver. The acquisition must not proceed, if the thresholds are met, unless a waiver is granted or a notification is approved. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: From the deal documents the lawyer selects, build a working table mapped to the questions on the ACCC notification-waiver application form: the parties, the acquisition, overlap, vertical or conglomerate links, and the four factors the ACCC must consider. Do not write the application, the declaration, or a conclusion that a waiver should be granted.

- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court or regulator classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Do not use the waiver path where the file shows material overlap, a serial acquisition, or a need for third-party inquiries. The ACCC says those matters should be notified.
2. Confirm the four mandatory factors are addressed with facts from the documents, not with a conclusion.
3. The lawyer signs the declaration and arranges the fee. Payment is not the application.
4. Remind the client that a waiver does not displace section 50, and that the acquisition waits on a grant or on approval of a notification.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
