## Key facts

| Practice area | [Competition & Consumer Law (ACCC / ACL)](https://ailawframework.com/practice/competition-and-consumer-law.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Table each environmental claim, whether it refers to the product, the package or a portion, and the study or test on the file. Do not write a new claim. |
| What the lawyer must review | The FTC Green Guides, 16 C.F.R. Part 260, state the Commission's views on environmental claims. They do not confer rights and do not bind the Commission or the public. The Commission can still act if a claim is inconsistent with the guides, and it must prove a section 5 violation. Section 260.2 says a claim is deceptive if it is likely to mislead consumers acting reasonably and is material, and that a reasonable basis is required before the claim is made. In this setting that basis often requires competent and reliable scientific evidence. Section 260.3(b) says a claim should specify whether it refers to the product, the package, a service or a portion, unless that is clear. An unqualified recyclable claim on a plastic package holding a shower curtain is deceptive if any part of either, other than a minor incidental component, cannot be recycled. You decide whether the evidence supports the claim. |

## Checking plan

- What the AI does: Table each environmental claim, whether it refers to the product, the package or a portion, and the study or test on the file. Do not write a new claim.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not apply a recycled-content percentage or a carbon-offset rule. Those sections were not used for a figure.
- The guides are not a safe harbour. Section 5 is still the statute.
